We represent individuals in all types of employment related disputes including wrongful termination, sexual and racial harassment, disability discrimination, failure to accommodate, and more.
We treat our clients with compassion and caring to help get them through the difficulties of working in a hostile work environment.
Wrongful Termination
There are many laws that protect employees in the workplace. Although this is an "at will" state, meaning that an employer can fire an employee "at will", there are laws that protect employees from certain types of unlawful termination.
Termination can be unlawful if it is based upon one or more "protected categories", including gender, race, national origin, religion, disability, or another protected category. In other words, an employer may terminate an employee for any reason unless if it is based upon one or more protected categories. An employer also may not terminate an employee in retaliation for making a complaint based upon a protected category.
Sexual Harassment
It is unlawful for an employer to permit sexual harassment in the work place. Weiss Law Firm can help you eliminate a sexually charged work environment and take legal action, if necessary, to protect your rights.
It is unlawful for an employer to tolerate a sexually offensive work environment if it knew, or should have known, about the sexual harassment. If a supervisor or manager is engaging in the harassing behavior, then knowledge of the harassment is imputed to the employer. If it is a coworker that is engaging in harassing behavior, then you should immediately report it to a manager or HR. The employer has a duty to eliminate the hostile work environment and protect you from further harassing behavior.
