Factors That Affect Child Custody Determinations

In family law, the primary standard that the court uses to determine a custody case is always, “what is in the best interests of the child.” In addition, the court has weigh many factors when it makes its decision, including:

The age of the children

Potential Child Custody & Visitation Arrangements
There are three general custody arrangements that a court can order:

Sole custody: This provides one parent with sole physical custody and sole legal custody. Physical custody says where the child will live. Legal custody says who has control over the decisions regarding the child’s upbringing, such as medical care and religion.
Joint legal custody: Here, one parent retains sole physical custody, but both parents share in the decision-making responsibilities for their child.
Joint legal and physical custody: This occurs when the parents each share a substantial amount of time raising the children.
In sole custody situations, the non-custodial parent is awarded visitation, or parenting time. Each parent should pay a significant role in their child’s life, and parenting time helps to achieve it. Senior associate attorney Rachel Isaacs joined The Micklin Law Group in 2010 following a very prestigious family law clerkship in Cumberland County, as well as several years of family law experience with a solo-practitioner in South New Jersey. She holds licenses to practice law in the states of New Jersey, Pennsylvania and Florida.

RICHARD M. MUGLIA, ESQ.

Richard Muglia first worked with The Micklin Law Group in 2010 as a legal intern. He returned to this firm as an associate attorney in 2012 after graduating from Widener University School of Law. While in law school, Richard participated in the Pennsylvania Civil Law Clinic, primarily focusing on family law. At this time, he mainly handles family, estate and probate legal issues.

For Richard, the best thing he believes he can do for his clients is to bring a sense of calm and order to what can be a very difficult and confusing legal process. He takes the time necessary to keep his clients well informed of what they are facing, describing in clear detail what the process is, what they can expect throughout, and what he expects of them. This policy of open communication helps him to provide the utmost in client service.
