Under California law, if a lender is compliant with the law after 90 days of continuous non-payment a homeowner may find themselves in a legal state of home ownership known as Foreclosure and at risk of losing their home.

"LIEN STRIP", PERMANENTLY ELIMINATES MORTGAGES FROM YOUR HOME IN BANKRUPTCY

If you have a second or a third mortgage that is secured on your home and want to eliminate it, it can be accomplished in a Chapter 13 Bankruptcy. This process is called "LIEN STRIPPING."
Under a Chapter 13 Bankruptcy a second or third mortgage that is ENTIRELY UNENCUMBERED by the value of your home is allowed to be treated as an "UNSECURED DEBT" in a LIEN STRIP. In Re Lam 211 B.R. 36 (9th Cir. BAP 1997). Like a credit card you will be able to pay pennies on the dollar for this enormous debt. Mark earned his undergraduate degree from the University of California at Santa Barbara. He graduated from the Chapman University School of Law and was a member of Chapman's E.N.L.U.R.E. program, graduating with an emphasis in Environmental, Land Use and Real Estate Law. He was inspired to become an attorney because of numerous injustices he witnessed first hand, including but not limited to wrongful incarceration, fraud of the underprivileged, and bad faith representation by numerous insurance companies of its' insured. Armed with a passion to represent the common individual, an innate sense of fairness, and a willingness to fight for what is right, Mark zealously displays his advocacy and negotiation skills both in and outside of the courtroom.

Mark is a first generation attorney that is bilingual, speaking Spanish and English fluently. His mother, father and step mother were all teachers/educators and stressed the importance of learning and acquiring knowledge. Mr. Martinez believes that his best character traits are his work ethic and humility. Both his mother and father grew up in East L.A. and taught Mark that first, there is hard work and through that the opportunity to make an honest living in a profession that you are passionate about. Through this opportunity his father and mother and step mother taught him through humble example that one can make a positive difference in the world through action and hard work.
