The New Jersey Law Against Discrimination protects employees from sexual harassment in the workplace. Sexual harassment consists of unwanted comments or actions directed against an employee because of his or her sex. Sexual harassment can be of the quid pro quo type or the more common hostile working environment claim. In a quid pro quo claim, the employee's terms and conditions of employment are made conditioned upon accepting the sexual advances. A hostile working environment claim rises where the sexual comments or actions are severe and/or pervasive. Even one act of sexual harassment can be severe enough to support a claim. Harassment that occurs repeatedly and/or frequently can satisfy the pervasive requirement.

Wrongful Termination

Not all NJ employment terminations are unlawful. In New Jersey, as in most states, employment is at-will. That means that generally either an employee or an employer can terminate the employment relationship at-will at any time, for any reason or for no reason.

However, there are several exceptions to that general rule and many cases of wrongful termination in NJ. An employer is not permitted to terminate an employee for a discriminatory or retaliatory reason. At Schorr & Associates, our employment discrimination lawyers in NJ fight against discrimination in the workplace every day. An employer may not terminate an employee due to their age, race, gender, religion, or disability. An employer may not retaliate against an employee for whistleblowing or for filing a worker's compensation claim. An employer may face liability if the termination is in violation of a contract or collective bargaining agreement. Finally, an employer may not terminate an employee for a reason that would violate public policy, including, in some instances, constitutional violations.

Adam is a lifelong resident of New Jersey. He attained his B.A. in Philosophy from The College of New Jersey in 2011 and his J.D. from Rutgers School of Law - Camden in 2014. At Rutgers School of Law - Camden, Adam spent two years on the Journal of Law and Public Policy. Adam has already spent many years with Schorr & Associates. Before he was an attorney, Adam gained valuable experience in the firm's practice areas working in various positions.

Matthew Schorr

Born in Philadelphia and raised in Cherry Hill, NJ, Matthew has spent most of his life in South Jersey. Matthew received his B.B.A. in Finance, Marketing and International Business from Hofstra University. He then attended Rutgers Law School, receiving his J.D. in 2015.

While at Rutgers, he was the President of the Student Bar Association, Student Leader of the Mediation Pro Bono Program, was on the executive board of several other organizations, and was involved in several other pro bono programs resulting in the Dean's Pro Bono Publico Award for over 100 hours of service. He was awarded with the Dean's Leadership Award as well as the Zack Award for excellence in Dispute Resolution. This past year he was awarded the prestigious Mary Philbrook Student Public Interest Award. He returned to Rutgers last year as a coach for the American Bar Association Representation in Mediation Competition. He coached four students, two of which came in third place in the nation.

Matthew is also active with the American Bar Association Dispute Resolution Section. After serving one year as the Law Student Division Liaison to the section, he was named the Chair of the Young Professionals Committee.

Upon finishing Law School, Matthew was hired as a Judicial Law Clerk for the Honorable Lee B. Laskin, J.S.C. at the Camden County Superior Court. Matthew spent time working in the Civil, Criminal, Family, and Special Civil Divisions during his time at the court.

Matthew is dedicated to helping every day working people get the justice they deserve. Matthew specializes in Alternative Dispute Resolution and will work hard to help his clients achieve favorable outcomes. Originally from Marina Del Rey, California, Arykah received her B.S. in Biology with a Minor in Chemistry from the Metropolitan State College of Denver. She then attended the Rutgers School of Law, receiving her J.D. in January 2009. Since becoming an attorney, Arykah has represented both individuals and companies in general commercial and civil lawsuits, including employment disputes, contract disputes, civil rights violations and personal injury. Originally from the suburbs of Chicago, Illinois, Jenelle Hubbard, Esq. joined Schorr & Associates as an associate in 2015. Ms. Hubbard graduated from Rutgers University New Brunswick, where she earned her B.A. in Labor Studies & Management in 2009. Ms. Hubbard received her J.D. from Seton Hall University School of Law in 2012. During law school, Ms. Hubbard was the Secretary of the Seton Hall Employment Law Society.

Since becoming a member of the New Jersey Bar in 2012, Ms. Hubbard has been aggressively defending and protecting employees' rights in employment discrimination, wage and hour disputes, and civil rights matters.
