Auto Accident

Experienced Trucking Accident Law Firm

Truck drivers work very long hours and often have tight schedules. One of the major reasons trucking accidents happen in the United States is because of driver fatigue. When a driver is excessively fatigued, their performance can drop to the level of an intoxicated person. They also have a decreased ability to evaluate their own level of fatigue which can severely impair their judgment.

Trucking accidents are collisions involving semi-trucks, tractor-trailers, 18-Wheelers or other commercial vehicles that cause property damage and/or personal injuries. Around 500,000 trucking accidents occur every year in the United States.

Trucks are extremely heavy, when pulling a full load. Often semi-trucks weigh in excess of 80,000 pounds. This is 20 times the weight of most cars on the road. Obviously, when a truck collides with a vehicle weighing 1/20th its weight, the results can be catastrophic. Of the previously mentioned 500,000 truck wrecks, approximately 5,000 trucking accidents result in fatalities. In fact, one out of every eight traffic fatalities involves a trucking collision. The drivers of the tractor-trailer often escape with no injuries because their vehicles are so much larger than the ordinary cars.

Common causes of truck accidents include: unlicensed driver, speeding, disobeying safety procedure, motor vehicle inspection failure, repair and maintenance failure, DUI/DWI, driver fatigue, truck rollover, backing up, vehicle collision, mechanical failure, tire blowout, transporting equiptment, overloaded trailer and loads that shift weight.

Commercial trucks have special rules, regulations and laws that they must obey. One rule is that truck drivers must obtain necessary rest and restorative sleep. If you are involved in an accident where the driver fell asleep, you may end up trying your case in Federal Court. Truck drivers are required to keep driving logs. When they are involved in an accident, evaluation of the log is critical. The log may be used to show violations of Federal hours-of-service regulations, intentional illegal conduct and negligent conduct. With emerging technology, attorneys have access to more evidence to help their clients. Computerized dispatch records, cell phone forensics, GPS technology and computer animations make it possible for attorneys to better investigate their cases. The trucking industry is also discussing going to electronic logbooks.

If you are involved in a trucking accident, make sure that you document the accident the best that you can. If you believe you need legal help, call an experienced attorney as soon as possible. The attorneys at Rotts & Gibbs, LLC have such experience and they know that it is important to begin gathering information necessary to pursue the claim immediately. A truck accident attorney like the attorneys at Rotts & Gibbs, LLC can help you with your case. They can help you get the compensation you deserve to help cover the costs of medical bills, physical therapy fees, vehicle repair and lost wages.

Because most cases of this nature are done on a contingency fee basis, most of the time you will not be required to provide any money to pursue your claim and the attorneys will pay for the expensive and necessary costs to properly pursue your claim.

Our Missouri Trucking Accident Attorneys are currently pursuing claims from big truck accidents and would like to discuss your potential claim with you. Our Mo attorney firm has a team of lawyers, paralegals and assistants who work together on claims such as this.
