Tax Deferred Real Estate Exchanges
In the sale of real estate, the Seller/Taxpayer is permitted to exchange their interest in the relinquished property (property being sold) for a replacement property of equal or greater value and defer the payment of capital gain taxes and recapture of depreciation. This is completed in accordance with Section 1031 of the Internal Revenue Code and the 1991 Regulations which outline the use of a Qualified Intermediary to successfully complete the transaction.
