Example cases

Often, my best work is when I am able to convince the Government to drop charges or not to charge my clients. One client allegedly was involved in a sophisticated mortgage fraud scheme. However, even though many other alleged participants were charged and sentenced to jail time in federal prison, my client was not charged. Another client was allegedly involved in an international alien smuggling and fraudulent federal document manufacturing scheme. Again, while my client was not charged, the other alleged participants were convicted and served federal prison time. Another client was charged with defrauding the FBI and the federal government. One week prior to trial, after a multi-year FBI investigation, the Government dismissed charges against my client because of evidence that the defense investigation had uncovered. Even when a client is sentenced, my past experience as a federal prosecutor is invaluable. A recent client was represented by another attorney and was being told to accept an 8 year prison sentence. The client then hired me and I investigated the case, picked apart the sloppy federal investigation, and then negotiated a 10 month sentence.

The only effective way to counteract and respond to an investigation is to understand how those investigations are conducted. As a former federal prosecutor, Richard Rice has worked with federal investigators such as the FBI, IRS, IRS CID, DEA, Diversion, U.S. Customs, Secret Service, ICE, ATF, and the U.S. Marshals, as well as state and local law enforcement agencies. This “inside” experience and knowledge is required when you are under investigation. When your future is at risk, knowing when to assert a defense can be as important as having a defense. It is a small consolation that you were blameless if the investigation destroyed all that you had built before the Government recognized this. Do not let this happen to you. How did your firm decide on the primary area of practice(s)?

I began practicing criminal law while a Navy JAG in San Diego, California. I quickly discovered how easy it was for a defendant to be railroaded by the system just because a cursory glance made someone look guilty. But, if an aggressive criminal defense attorney investigated and defended a case, the truth often was much different.

What is your firm's point of view regarding clients educating themselves on legal issues?

Clients who educate themselves are a benefit to the attorney because the more a client understands what the issues are in a case, the better able the client is to provide information helpful to the attorney and to make informed decisions about how to proceed in the case.

Is your firm willing to review documents prepared by clients?

I will review materials prepared by the client, but the final decision of what documents are filed in a case rests with the attorney

Is your firm willing to coach clients who want to represent themselves?

I do not assist persons who represent themselves pro se.

Richard Anthony Rice, Jr.

Prior to establishing Bomar Rice, LLC, Richard Rice was an Assistant United States Attorney in Atlanta, Georgia. Prior to becoming a federal prosecutor, Richard Rice was a Trial Attorney with the Special Litigation Section of the United States Department of Justice, an attorney with Kirkland & Ellis and Hunton & Williams in Washington, DC, and a Naval Officer in the United States Navy Judge Advocate General's Corps (the JAG Corps).

Having both prosecuted and defended criminal cases for over eighteen years, and having run major federal criminal investigations while a federal prosecutor, I understand how cases are and should be put together. More importantly for my clients, I can identify and exploit holes or lapses in an investigation. Juries find defendants "not guilty" because the police did an inadequate job investigating a case arguably more often than they do so because they believe someone is innocent.

I am an aggressive attorney who fights for every last advantage for his clients. As a former federal prosecutor, I know that aggressive defense attorneys achieve the best result for their clients - and that too many attorneys do little work on a case and simply accept whatever deal the Government first offers a defendant.
