When an individual is charged with a crime that is sexual in nature, he or she will likely not initially understand the gravity of the situation and the difficulty that lay ahead. Resultantly, a person might decide to speak with law enforcement or local social service authorities in an effort to explain his or her side of the story. What people often do not understand, however, is that when an allegation of a sexual crime is made, especially when the alleged victim is a child, the presumption that the accused is innocent until proven guilty seems to be inapplicable.

Sometimes very little effort is made by law enforcement and social service agencies to investigate whether such allegations could be false. Instead, the focus of their efforts is to obtain evidence that corroborates the allegations. The fact is that unless it was impossible for the act to have occurred, or the alleged victim recants his or her allegations, the case will move forward.

In cases involving minors, it is not uncommon for the chief or sole evidence to be presented at trial to be live testimony by the accuser along with recorded testimony of the accuser that is played in an effort to bolster the accuser's credibility. Additionally, certain out-of-court statements that would not be admissible in other types of cases are allowed specifically for these types of cases.
