Firm Overview

Richards Patent Law is a full service patent prosecution and counseling law firm located in Chicago, Illinois, and serving clients across the country and around the world. I work closely with my clients to identify appropriate intellectual property strategies aligned with their business goals.

I started Richards Patent Law in spring of 2009, in part to bring the quality services typically reserved for large multinational corporations within reach of smaller and mid-sized businesses, start-ups, and entrepreneurs.

Representative litigation: I represented a medical device patent owner against a leading multinational medical devices company for utility patent infringement of multiple patents. I represented an electrical connector manufacturer and patent holder in a design patent infringement case. I represented the defendant corporation against claims of infringement of display signage utility patents. I represented the defendant corporation against claims of infringement of electrical network and communication utility patents.

Free Initial Consultation?

I offer free consultations for all matters. The free consultation lasts as long as needed for me to understand the matter, plan an appropriate intellectual property strategy and provide a fixed fee or hourly fee estimate for completing the matter. At that point, the client understand the process, our plan and the fees required to move forward.

Services Offered For Fixed Fees?

The majority of services I provide are on a fixed fee basis. My specific value based patent fee philosophy is explained in greater detail on my website.

Is your firm willing to help a client with one discrete part of a case, without taking on the whole case?

My father is a lawyer who also runs his own practice. I have always been interested in becoming a lawyer, but my experiences in law school, particularly my classes with Judge Rader of the Federal Circuit Court of Appeals, truly solidified my passion for the profession.

What are your policies about dividing work within the firm to make the process most cost-effective for the client?

I am a better lawyer because of my ability to relate to being a client. I believe communication is key, whether it is in helping a client understand the strategy to be implemented or simply returning phone calls and emails promptly. In my experience, nothing is more frustrating as a client than feeling removed from the process. An educated client involved in guiding the legal decisions is a happy client.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

I'm a problem-solver by nature with a specific interest in technical subjects. Patent law allows me to constantly put my problem-solving skills to task in technical fields.

Does your firm provide pro bono legal services or otherwise participate in your community?

The diversity of my clients and their matters keeps my work interesting, the complexity of the subject matter keeps me challenged, but what I like best is working with clients to strengthen their businesses and products.

What distinguishes your law firm from others?

As a solo practitioner, I work directly with every client and am the primary point of contact for all matters. If I am out of the office or otherwise unavailable, you may reach my assistant who will be able to tell you when you should expect to hear from me. If you are especially lucky when speaking with me on the phone, you may hear that my dog has joined me in the office that day.

What is your firm's point of view regarding clients educating themselves on legal issues?

I am strong proponent of client self-education. To assist clients in the process, my website includes an extensive patent FAQ section tailored to help clients educate themselves in all aspects of patent matters.

Is your firm willing to review documents prepared by clients?

In nearly every instance, the documents I prepare and file with the United States Patent and Trademark incorporate some materials prepared by my clients. To the extent that a client is able to provide appropriate materials that aid in the completion of the final documents, I am very willing to review documents prepared by clients. However, patents and patent-related documents are not the types of documents most clients are equipped to prepare themselves, they nearly always require substantive preparation by an attorney.

Is your firm willing to coach clients who want to represent themselves?

I have found that in patent law in particular, it is often more difficult and expensive to coach clients who want to represent themselves than it is to do the work correctly myself.

I was previously a partner in the intellectual property practice group in the Chicago office of McDermott Will & Emery, LLP. I started with McDermott as an associate straight out of law school and left the firm in late 2008 to start Richards Patent Law.

I am a better lawyer because of my ability to relate to being a client. My style is very hands-on. I like to spend time with my clients during the free consultation period to really understand their inventions and business needs. My intention is to optimally align your patent strategy with your business objectives. My reviews speak to my strengths from the perspective of my clients.

Personal interests:

I'm a husband and a dad and my favorite times are spent with my wife and son. I'm a musician that loves to create music with others. I'm also an aging athlete that finds few things more enjoyable than a round of golf with my dad.
