Andrew Needle

Andrew Needle is Board Certified in Civil Trial Law by the Florida Bar. Following graduation from Cornell University in 1974 and the University of Miami, cum laude, in 1977, he began practicing law with one of the premier personal injury and medical malpractice firms in Florida. Since then he has distinguished himself professionally both in and out of the courtroom as a trial lawyer, author, and lecturer.

He is a charter member of the Miami chapter of the American Board of Trial Advocates, a trial lawyer organization dedicated to the preservation of the civil justice system and for which admission is solely by peer recognition and experience. Mr. Needle's courtroom victories include multi-million dollar verdicts in cases that have often pushed the outer boundaries of existing legal precedent. Andrew L. Ellenberg

Mr. Ellenberg is "AV" rated by Martindale Hubbell (the highest rating for both legal ability and ethics). Over the course of a professional career which began in 1988 he has developed expertise handling the wide range of cases which make up a personal injury practice. He has been recognized by fellow attorneys as one of Florida's best trial lawyers in the field of personal injury, wrongful death, medical malpractice, elder neglect and abuse and civil trial practice. Mr. Ellenberg has obtained significant results for his clients in a wide variety of personal injury and wrongful death cases. For more than fifteen years he has been vigorously pursuing his clients' rights to money damages in cases where personal injury or death has been the result of carelessness, negligence, product liability, medical malpractice or the violation of other legal rights. Mr. Ellenberg has earned a statewide reputation for excellence in handling of all manner of personal injury and wrongful death cases. He has developed particular expertise in cases involving birth injuries caused by the neglect of health care providers during pregnancy, labor and delivery. Handling birth injury cases, whether they involve catastrophic brain injury to the newborn, or nerve damage which causes paralysis to a limb, requires a significant commitment of time, energy and expertise in order to properly demonstrate the cause of the injury as well as the financial and emotional toll on the injured child and family. He has achieved numerous substantial awards and settlements, including many multi-million dollar results, in cases involving cerebral palsy, brain damage, brachial plexus palsy, Erb's and Klumpke's palsy, and wrongful death.

Mr. Ellenberg spent the first few years of his practice primarily defending product manufacturers, airlines and airplane manufacturers, and the health care industry in high exposure personal injury and wrongful death lawsuits. That experience provided invaluable insight into how the insurance industry and the corporate world viewed, analyzed and resolved personal injury and wrongful death cases, product liability cases and medical malpractice cases. During those early years of practice he decided that his enthusiasm, talent and ability would be best served fighting for the rights of those injured, or the families of those who had died, as a result of defective products, careless healthcare or other neglect or abuse. Since 1991 he has devoted 100% of his practice to the representation of plaintiffs in cases of injury or death caused by neglect, abuse, medical malpractice, product liability or the violation of other legal rights.

Mr. Ellenberg has helped colleagues develop their skills and lectured to his peers about the handling of personal injury and wrongful death cases, medical negligence cases, trial advocacy, elder abuse and nursing home abuse and neglect. He has co-authored several articles and publications on these subjects.

Sally (Gross) Herring

For the past decade, Ms. Herring's special interest has been appeals. Her appellate accomplishments include Walker-White v. Pezzullo-Burgs (non-economic damages), Rodriguez-Cespedes v. Creative Leasing (long-term lessor statute), Barbakow v. US Air, Inc. (federal preemption), Rubio v. State Farm (first party bad faith), United States v. Hernandez (sentencing), United States v. Pierre (guilty plea). As well, Ms. Herring has won many per curiam rulings on behalf of our clients.

Ms. Herring's unusual background as a law enforcement officer, clinical social worker and educator no doubt contributed to the University of Miami's decision to award her a full Dean's Honor Scholarship. She graduated magna cum laude, 2nd in a class of 347. While in law school, Ms. Herring served on the Law Review and founded the Badge and Gavel Society, a mentoring organization for law enforcement officers becoming lawyers. She was law clerk to the nationally admired and respected Honorable Peter T. Fay of the Eleventh Circuit Court of Appeals. Consistent with her love of writing and diverse interests, Ms. Herring has published articles of importance to lawyers, law enforcers, and social workers.

Currently of counsel to the Firm, Ms. Herring provides outstanding trial support and appellate services.

Christopher S. Prater

After receiving his Bachelor's degree from the University of Arkansas in 2010, Chris Prater moved to Miami. He attended the University of Miami School of Law and received his Juris Doctor degree, Magna Cum Laude, in 2013. During law school, Chris was a member of the Executive Board of the Charles C. Papy Moot Court Board, a member of the Federal Appellate Clinic, received the highest grades and Book Awards in Civil Procedure, Evidence and Legal Writing.

Before joining the firm, he served as a judicial intern for Florida Third District Court of Appeal Judge Richard Suarez and clerked at well-known civil and criminal litigation firms in Miami. His current practice includes medical and hospital negligence, motor vehicle negligence, and wrongful death claims.
