The Liviakis Law Firm uses California bankruptcy law to eliminate debts, help retain property, and help rebuild a better financial future. Liviakis starts by stopping creditors from collection and then helps to rebuild your credit after bankruptcy. When your debt is more than you can handle you need debt relief solutions to avoid being taken advantage of by credit card companies with high interest rates and mortgage companies that have put your into mortgage you can't afford. Just give our experienced attorneys a call.

Most people that need debt relief choose Chapter 7 or Chapter 13 bankruptcy depending on their level of income and what kind of debt they have. Our California bankruptcy attorneys help you choose the right type of bankruptcy for a fresh start.

Chapter 7 is a liquidation bankruptcy intended to clear away unsecured debts like credit cards, pay day loans, and medical debt. To qualify for Chapter 7 bankruptcy, you must pass the means test. The means test provides income guidelines for each person based on their family size and where they live. The Liviakis Law Firm calculates the means test for you based on your pay stubs.

Chapter 13 reorganizes your debt and in many case unsecured creditors (credit cards, ect.) still receive little to no payment. Mortgages and car loans on the other hand receive a reduced amount that fits within your budget and allows you to stay in your home and keep driving your car. That means that hard working individuals keep more of their income for living expenses to support their family. Many debtors choose to file for Chapter 13 bankruptcy because it helps them catch up on their mortgage payments, avoid foreclosure, and to retain their real and personal property, while protecting it from creditors.

We will help you qualify for bankruptcy even in tough cases where you have a unique financial situation or you make more money than the average person we can still help you reduce debt. The good news is that bankruptcy does not require you to hand over your possessions. The Liviakis Law Firm understands how important your property is and we know how to protect it from the creditors. Our attorney use a variety of strategies to keep you in your home, save your retirement and your bank accounts.

When we file bankruptcy we will actually be reseting your credit. That means that the late payments, defaults, foreclosures, and repossessions that are 90 days or more past due, will be reset. This is crucial to actually improving your credit and your score. Just ask us for a special credit report and we can project your credit score after bankruptcy. Often times is will likely increase in the future.

We don't rush you through the process and we answer your questions along the way.

How did your firm decide on the primary area of practice(s)?

Estate planning and bankruptcy both involve the preservation of money and other assets for oneself and one's family. I know how important it is to have the financial tools and infrastructure to continue to prosper in the community. I am an advocate who is focused on results and who serves the client with compassion.

What is your firm's point of view regarding clients educating themselves on legal issues?

It's very important that each client is properly informed and kept up to date about the case from the beginning to the end. I work with each client to explain the process and keep them up to date on the decision that they make. Self-preparation may help the client understand the process, but it also may also lead to confusion and misunderstanding.

Is your firm willing to review documents prepared by clients?

I find that the best way for me to ensure that a legal document is properly prepared is to personally prepare it from the beginning to the end.

Is your firm willing to coach clients who want to represent themselves?

Since I am concerned about the outcome of the client's case, I would not endorse self-representation in most cases because of the increased risk of failure to the client.
