How did your firm decide on the primary area of practice(s)?

Initially, our firm's decision to focus our practice on environmental law grew from my past experience as a public-interest lawyer bringing civil lawsuits to force the federal government to comply with its own environmental laws, and as a criminal prosecutor bringing environmental criminal prosecutions against companies who were violating state environmental laws. The firm became involved in complex civil environmental litigation in which the EPA and state Departments of Environmental Protections sought millions of dollars from hundreds of companies for contaminating landfills and industrial sites with hazardous wastes. We developed a leadership role in negotiating, litigating and settling those cases, and transferred those skills to handling complex litigation in other fields as well, such as healthcare and construction litigation.

What experience or education distinguishes your lawyers from others?

The experiences which distinguish our firm's lawyers from other lawyers are the knowledge, skill, and judgment that they have developed from participating in sophisticated, complex litigation. We are respected for the creativity that we bring to analyzing our clients' problems and formulating successful strategies designed to get them the outcome they need. We are adept at using different kinds of alternative dispute resolution (ADR) techniques to steer cases away from expensive and time-consuming litigation. We have been highly effective in settling EPA compliance cases through having our clients perform unique "Supplemental Environmental Projects" which benefit environmental protection and natural resource restoration, rather than merely paying huge fines. Some of our lawyers also have prior professional backgrounds which are valuable to their work, such as one environmental attorney's experience working for the EPA, and a healthcare attorney's experience working for hospitals and a life care community.

What distinguishes your law firm from others?

More than anything else, what distinguishes our law firm from others is the quality and thoroughness of our legal work. A highly respected environmental lawyer from one of New Jersey's largest law firms (who was our adversary in a major Superfund case) once described a brief our firm wrote as "the single best brief I have ever read".
One judge recently described the thoroughness of our work as "dotting all the i's and crossing all of the t's, before the judge even knew that there were i's to dot and t's to cross". When representing a pharmacist seeking to prevent suspension of his license to practice pharmacy, we visited the Board of Pharmacy's office to review every single past disciplinary decision available in their files, in an effort to identify other cases where unusual circumstances had warranted imposing a more lenient penalty. When challenging the Environmental Protection Agency's decision to impose three separate fines, rather than a single fine, for not submitting copies of the same report to three separate government offices, we reviewed every enforcement action brought by each of EPA's ten regional offices, in order to show that EPA's action was "arbitrary and capricious" because in many other cases it had imposed only a single penalty.

How did your firm decide on the primary area of practice(s)?
