Firm Overview

We are a consumer bankruptcy law firm handling Chapter 7 and Chapter 13 cases. From our Middletown, New York office we serve Orange, Sullivan, Ulster and Dutchess Counties and communities including Middletown, Newburgh, Port Jervis, Goshen, New Windsor, Monticello, Liberty, Ellenville, New Paltz, Kingston, Beacon and Poughkeepsie. The law firm was formed in 1981 by Guy Hayward and Richard Parker. Christopher Martens joined the law firm in 1984 and remained a member until he became a full-time Middletown City Court Judge in 1991. I joined the law firm in 1986 and became a partner in 1991. Richard Parker passed away at a much too young age, dying in 2006 at the age of 59. Guy Hayward is semi-retired and living in upstate New York. Michael Pinsky joined the firm as a partner in 2009. Michael Pinsky and I are career bankruptcy lawyers dedicated to helping people solve their financial problems.

Example cases

Many Chapter 13 cases where second and third mortgages have been avoided and reclassified as unsecured claims, allowing clients to repay them over the life of their Chapter13 plan for a fraction of the amount due. Countless cases where judicial liens encumbering residences have been avoided, thereby removing said liens from the public records. Countless cases where wage garnishments and bank account restraints have been eliminated. Numerous cases where residential mortgages have been successfully modified pursuant to the Loss Mitigation Program adopted by the Southern District of New York in January, 2009.

Free Initial Consultation?

Free consultations are offered, and last as long as necessary to adequately explore a client's problems and options. We usually set aside about an hour and fifteen minutes for a typical consultation.

Services Offered For Fixed Fees?

Fees for Chapter 7 and Chapter 13 cases are determined based upon the complexity of the issues involved and the projected time and number of court appearances that will be required to achieve the client's desired results. However, the legal fees for a generic (i.e., no complicated or time consuming issues) Chapter 7 case start at $1,500, and the legal fees for a generic Chapter 13 case start at $3,500. Clients are also responsible for paying the court's filing fee, which is $306 in a Chapter 7 and $281 in a Chapter 13.

How did your firm decide on the primary area of practice(s)?

The attorney who I initially worked for handled bankruptcy cases, so I became exposed to bankruptcy cases at the very beginning of my career, and never looked back.

What is your firm's point of view regarding clients educating themselves on legal issues?

I strongly urge potential clients to educate themselves on bankruptcy related issues prior to scheduling a consultation, and find that many of them have already spent varying degrees of time reviewing my website in preparation for their consultation.

Is your firm willing to review documents prepared by clients?

Client prepared bankruptcy documents setting forth the names and addresses of their creditors are always helpful, and client prepared budgets occasionally can be a good starting point for such issues. However, since many clients frequently have no idea where their money goes (which is frequently the reason they are talking to a bankruptcy lawyer in the first place), such budgets cannot be considered to be the Gospel. Client prepared bankruptcy petitions using forms obtained over the internet are usually of limited value, as the inquiries set forth on a bankruptcy petition are often difficult for a non-lawyer to comprehend. It is hard for a client to provide a reliable answer when they may not even understand the question.

Is your firm willing to coach clients who want to represent themselves?

Our office does not "coach" people who want to represent themselves in a bankruptcy. While a person is free to do anything that they want by themselves, including performing their own lobotomy or extracting their own tooth, such activities are ill-advised in my opinion. It is equally ill-advised for any lay person to handle a legal proceeding as complicated as a bankruptcy. Bankruptcy has many pratfalls for the unwary, and a misstep can frequently have dire consequences. As a Chapter 7 Trustee I have administered many pro se (i.e., filed without a lawyer) cases that should never have been filed and which resulted in the debtors losing houses, cars, tax refunds and other valuable assets.

My 30+ years as a consumer bankruptcy attorney, coupled with my being a Chapter 7 Trustee since 1994, provides me with a broad and unique understanding of the bankruptcy related issues that must be dealt with by clients trying to successfully navigate their way through bankruptcy in order to get their financial lives in order.

My biggest strength is the broad knowledge and expertise that I bring to the table for the benefit of my clients. My style is an exhaustingly thorough one, but clients tend to be at ease with me, probably because my background is not unlike their own. Having grown up in a household where my parents were always trying to pay $3 worth of bills with the $2 that they had in their pocket, I generally have firsthand knowledge of what most clients are talking about.

Personal interests:

As an aging athlete, I am interested in virtually all sports. Having grown up in the 60s I love all music from that era. As an interested "citizen of the world" I watch the news events of the day with equal parts bemusement and horror, and wonder what the future holds.
