Firm Overview

Mays & Kerr is an employment law firm in Atlanta, Georgia, specializing in wage and hour matters. Our litigation practice focuses on representing individuals and business in cases arising under the Fair Labor Standards Act (FLSA), such as claims for unpaid overtime and retaliation in both single-plaintiff and collective actions. We routinely handle lawsuits involving the misclassification of independent contractors and salaried employees as exempt from overtime laws. We have a track record of defending employers against other employment-related suits, as well, such as discrimination and hostile work environment claims, and have litigated successfully in federal district courts and the 11th Circuit Court of Appeals.

Mays & Kerr also provides solutions for small businesses seeking to ensure compliance with federal, state, and local laws. For example, we conduct wage and hour audits for employers to evaluate their payroll and classification practices for compliance with the FLSA. We have extensive experience drafting employee handbooks and other documents critical to small businesses.

Is your firm willing to help a client with one discrete part of a case, without taking on the whole case?

Contact our office to discuss.

What are your policies about dividing work within the firm to make the process most cost-effective for the client?

Each and every case receives our team's attention and dedication.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

Mays & Kerr uses alternative dispute resolution tools, such as mediation, to narrow the gap between a demand and an offer.

Does your firm provide pro bono legal services or otherwise participate in your community?

We are involved in public interest matters such as environmental protection, employees' rights, and helping clients accomplish their own charitable goals. Please call to see if we can assist with your public interest project.

What distinguishes your law firm from others?

Mays & Kerr's highest value is client satisfaction. To that end, we strive to provide the highest quality legal services together with the level of availability and customer service that only a small firm can provide.

What is your firm's point of view regarding clients educating themselves on legal issues?

We help our clients to understand their legal issues so that they can be aware of their rights and bring to our attention all of the relevant facts. We love to have clients who are involved and want to understand the complexity of the legal process.

Is your firm willing to review documents prepared by clients?

Yes.

Is your firm willing to coach clients who want to represent themselves?

In general, we do not coach pro se clients. If someone is our client, then we will handle court appearances, negotiations, and document drafting. In some limited cases, we may be able to coach a client who is trying to reach a specified goal.

Mays & Kerr was a merger of Jeff's and John's solo practices in early 2011. The merger has afforded the attorneys at Mays & Kerr more resources, expertise, and efficiency, and as a firm, Mays & Kerr has substantially increased its caseload. The end result is high quality service to clients at manageable rates.

Each and every case receives our team's attention and dedication.
