Felonies

Mr. Champagne defends all types of felony charges, including drug charges and violent crimes. The importance of filing proper motions is essential to assure your Constitutional rights are protected. After theses motions are filed, the State has the burden to prove proper procedure was followed from the time of your arrest to the disposition of the matter. If the proper motions are not filed, your rights are not being properly protected. Mr. Champagne assures that all proper motions are filed and sufficient responses are received.

Misdemeanor

Mr. Champagne defends all types of misdemeanor charges, including simple battery, possession of marijuana, and domestic violence. As is the case with felonies, proper pretrial motions are essential in protecting your Constitutional rights. In misdemeanor cases, you are entitled to a trial before a judge. The State bears the burden of proving beyond a reasonable doubt that you did in fact commit all of the elements of the crime you are charged with.

Juvenile Law

Louisiana law, as it relates to juveniles, is different from majority law, i.e. 17 years and older. Matthew Champagne has the knowledge and experience to properly represent these young adults and promote their best interest.

Traffic Tickets

The arresting police officer is required to follow proper procedures in all traffic stops. Radar devices are required to be calibrated and documented periodically to assure their accuracy and authenticity. All of these issues must be taken into consideration when looking at traffic violations.

DUI and DWI
DWI laws are constantly changing due to the stringent lobbying in the Louisiana Legislature. As a result of these changes, Mr. Champagne is constantly researching and studying the amendments and modifications to protect his client'™s best interest.
A 1st or 2nd DWI is a misdemeanor. However, a 3rd or 4th DWI is a felony. In order for the State to get a conviction on a 2nd, 3rd or 4th DWI, it has the burden of proving that the prior convictions were done appropriately under Louisiana Law. If these prior convictions were not proper, then the State cannot use them for enhancement purposes on the new charge. Proper motions and hearings are absolutely necessary to ensure that your Constitutional rights are protected.

Mr. Champagne takes every measure to assure that the State meets its burden.
