Leyba Defense PLLC, a Seattle DUI law firm, represents individuals accused of Criminal and DUI offenses throughout Western Washington and its surrounding areas. Our mission is to provide the highest quality legal Criminal and DUI Defense to our clients, to protect their constitutional rights, and to ensure a fair trial from the prosecution.
In 2010, I began my own law practice and opened Leyba Defense PLLC, a Seattle DUI Firm, and Criminal Defense firm focusing on DUI and serious traffic offenses throughout Western Washington and its surrounding areas. As a Seattle DUI Lawyer it's an important part of my practice to be thoroughly trained in DUI defense. I am currently a NHTSA qualified administrator of the standardized field sobriety tests, the same tests every trooper and police officer is trained to administer. I am also an experienced Seattle DUI Attorney, having litigated over 100 jury trials to verdict, most often winning favorable results for my clients. My practice is devoted 100% to litigation, and I will never turn down a client because it may be a difficult trial.
Currently my Seattle DUI Law Firm has a high success rate in getting a DUI dismissed or reduced to a lesser offense. Here are some examples of some of my most recent cases:
Seattle Municipal Court: My client was charged with a Seattle DUI, Negligent Driving 1, and Assault. The client allegedly was speeding and ran a red light causing a two car collision. After the accident, the client got out of his car, allegedly punched the other driver then attempted to drive away. Several independent witnesses had to wrestle the client out of the car. Client admitted to drinking two long island iced teas, and taking medications. Officer testified that client was extremely impaired. The jury returned a verdict of Not Guilty.
Seattle Municipal Court: My client was charged with a 4th offense Seattle DUI and driving while license suspended. At trial the arresting officer testified that the client was speeding in downtown Seattle, and made a sweeping right turn causing his vehicle to swerve into oncoming traffic. Officer testified that the client was impaired, noted red, watery, and bloodshot eyes. Client admitted to drinking beer and stated shouldn't have driven. Client refused the breath test at the station. A jury returned a verdict of Not Guilty. As Seattle DUI Lawyer this was the absolute best outcome for the client.
Seattle Municipal Court: My client was charged with physical control. This was a second offense Seattle DUI Arrest. The client was seen by a police officer passed out inside of her vehicle on the side of the road with the car running. Officer testified at trial that client was extremely intoxicated, failed all the field sobriety tests, and couldn't walk without the officer's help. Client admitted to having 6 strong mixed drinks and had an alcohol level of .19 and .20. A jury returned a verdict of Not Guilty.

I chose to practice in the area of Seattle DUI Defense because this is an area of law that encompasses my two passions, jury trial work, and helping those in need. I thoroughly enjoy it, and I can't imagine doing anything else.
In law school I worked at a public defenders office where I gained valuable trial and litigation experience. It was here where I knew that I wanted to be a trial lawyer in criminal defense. After graduation I went to work at the largest criminal defense firm in Seattle, WA. While there most of my cases were DUI related, and this when I knew becoming a Seattle DUI Lawyer was what I wanted to do.
After 5 years at the job I left and started my own law practice focusing on Seattle DUI Defense and the defense of other serious traffic offenses.
I think it is of vital importance for a person to understand the legal process, what their options are, and how to get the best results. In addition to that when interviewing potential Seattle DUI Attorneys, the more a person is familiar with the process, the better questions they will be able to ask. I have complied a list of Seattle DUI Lawyer questions to ask when interviewing a DUI attorney that will help you find the best attorney to represent you and fight on your behalf.
A lot of Seattle DUI Lawyers like to run their own show, and prepare your defense the way they want it. The problem with that is this is your case, and chances are you were contacted by the police officer without your attorney being present. So you will have a better understanding of what happened, what the police officer said to you, and how you felt you acted. I can't tell you the number of times I have had clients bring me documents, or tell me what they thought about their case, and those pieces of information ended up being extremely helpful and in some cases directly resulted in the DUI being dismissed. I am very open to having clients help with their defense, and in fact I strongly encourage it in my Seattle DUI Defense practice.
You should never attempt to represent yourself on a DUI charge. I have been a Seattle DUI Attorney for quite some time, which means I'm in court all over the state almost every day. On occasion, I've had the opportunity to view people who elected to represent themselves on a DUI charge. And I can tell you not once did this work to the advantage of the accused. I saw some interesting theories on why they were arrested, but I never saw anyone who actually did this get found not guilty or come away better off.
I began my legal career working at the Spokane County Public Defender's Office in Spokane, Washington. During my two years in Spokane, I represented individuals accused of DUI and other alcohol related offenses. In 2006, I left Spokane to work in Seattle, Washington at one of the largest criminal defense law firms in the State. While there, I represented thousands of clients accused of a wide variety of criminal offenses. It was during this time that I built my reputation as a skilled trial attorney and a tireless advocate for my clients.

I believe in fostering relationships. What I mean by that is I try and maintain good professional relationships with the prosecutors, judges, and police officers. Maintaining these relationships helps me better defend my clients, because I am trusted and known as a straight shooter. There is a time and place to be aggressive and pushy, and a time and place to be polite and professional. The great trial attorneys are able to balance both styles, while at the same time being a zealous advocate for their clients. I mirror my practice after this philosophy and I feel it is very effective in getting my clients the best resolution possible.Personal interests:
Prior to becoming a Seattle DUI lawyer, I worked at two golf courses in Salt Lake City, Utah, and Spokane, Washington. Although I don't get to play as many rounds as I used to, I still enjoy playing. I also enjoy traveling and hanging with my wife.
