Chicago Hospital Malpractice Attorney

Firm Overview

Illinois Medical Misdiagnosis Attorney
If you or a family member has suffered serious harm in Illinois because of a doctor's error (misdiagnosis, surgical error, or prescription error, for example), my firm can help you through this difficult time. Contact me, Chicago medical malpractice lawyer Valerie Leopold, to discuss your experience and what you can do next.

There are all types of misdiagnosis cases. Sometimes a doctor or hospital fails to diagnosis an illness, such as cancer, a bone fracture, meningitis, or a heart attack. As a lawyer, I have successfully handled cases for failure to diagnosis heart conditions, brain injuries, breast cancer, lung cancer, colon cancer, Hodgkin's lymphoma, and prostate cancer.
I have also won cases where patients are given an incorrect diagnosis. For example, I recovered $4.8 million for a young woman who was diagnosed as having the flu, when she actually had a brain infection called herpes encephalitis. Similarly, I obtained hundreds of thousands of dollars for a young man who was told that he was HIV positive when he actually did not have the AIDS virus.

In my experience, mistakes are frequently made when doctors and nurses are rushed and do not spend enough time with the patients. Similarly, mistakes can occur when a patient is seen by too many doctors, residents, and nurses and no one person understands the patient's history or overall problems.

Frequently, after thorough preparation and obtaining qualified experts who are willing to testify that malpractice occurred, I have been able to successfully settle these types of cases before proceeding to trial. If you feel that you have been misdiagnosed or an error has been made, contact me. We can discuss it.

At Leopold & Associates, LLC, the same techniques used to win medical malpractice cases are applied to all accident cases. As an attorney for 30 years, I have handled brain damage, paralysis, death, amputation and other injuries from not only car accidents, but also accidents involving motorcycles, buses, bicycles, horseback riding, playground equipment, toys, trains, medical devices and fires.

Where children or wage earners have been injured, I have frequently been able to obtain multi-million dollar structured settlements that will support them for the rest of their lives. When an injury is permanent, the amount recovered should last a lifetime.

Trucking Accident
Chicago Car Accident Lawyer
Serious auto accidents commonly cause more than physical pain and monetary loss to the victim. Often, families are essentially destroyed as their former lives are nearly impossible to regain after catastrophic traffic accidents. If you or a loved one has been injured in an auto accident, contact me, Chicago car accident attorney Valerie Leopold to schedule a free consultation.

Investigating Car Crashes
The strongest cases are developed through a detailed, in-depth investigation immediately after the car accident. The longer you wait, the greater the chance that the information you need to prove your case will be unavailable, such as:

-Evidence of conditions at the time of the car crash may literally be washed away with the next rain, snowfall, or street cleaning.
-Shrubbery that blocked the view of street signs may be trimmed before being documented in preparation against a municipality or property owner.
-Witnesses may become difficult or impossible to track down for statements.
-Full documentation of injuries (including photos showing the full extent of the injuries before treatment) may be lacking if too much time goes by.

Often, events after a catastrophic or fatal auto accident are overwhelming to victims and their families. Police reports and investigations, insurance adjuster interviews and medical decisions come in rapid succession at a time of shock.
Car accidents need to be investigated quickly and thoroughly from the beginning. We will obtain all necessary evidence, photographs, medical records and bills in order to make a prompt demand. When reputable insurance is available we have been able to resolve cases in months not years.
Wrongful Death
Chicago Medical Malpractice Attorney
Illinois Medical Negligence Lawyer

When we entrust our health and well-being to the care of trained, licensed health care providers, we do so with confidence that acceptable standards of care will be followed. If you or a loved one has been injured because health care provider failed to follow these standards, contact me, Chicago medical malpractice lawyer Valerie Leopold to schedule a free consultation.

Emergency rooms, surgical centers, and birthing centers all have moral and legal responsibilities for the patients that they serve. When hospital negligence or medical error results in serious harm to or death of patients, medical malpractice claims are not only for the sake of obtaining monetary compensation for the injured or for the sake of the family left behind. A large settlement or verdict also sends a message to the medical community about society's expectations and demands that patients receive the highest standards of care.
Medical malpractice may encompass a wide range of events, including the following:

-Surgical error (leaving foreign objects in the body, operating on the wrong body part, erroneously severing nerves or blood vessels, and other devastating mistakes)
-Emergency room errors (failure to diagnose, failure to treat in a timely manner)
-Birth injuries like cerebal palsy, caused by negligence of OB personnel during pregnancy, labor, delivery, or neonatal care
-Drug mistakes (manufacture, prescription, or administration of defective drugs on the part of doctors, nursing homes, pharmacies, or pain clinics)
-Hypoxic or anoxic brain injuries resulting from anesthesia error or birth injury
-Misdiagnosis or failure to diagnose
-Failure to diagnose cancer or intracranial hematoma
-Failure to prevent and treat heart attack/stroke
-Hospital negligence including infections

Example Case
In one case, a pregnant woman with a known history of miscarriages was not given a simple procedure, called a cervical cerclage, to help prevent another miscarriage. As a result, she again delivered early and her baby became blind with retinopathy of prematurity.

In another case, a young woman was given an antibiotic that she was allergic to right before delivery. She had an anaphylactic reaction, resulting in her baby being born with permanent brain damage.

In each of these lawsuits, millions of dollars was obtained for each child.
