REAL ESTATE LITIGATION AND TRANSACTIONS

The Brewer Firm has its roots firmly planted in real estate! We are, at our core, a real estate law firm. All our attorneys are also licensed as real estate brokers, so we know the law and the business of real estate. We do both real estate litigation and transactions.
Our litigation covers such things as misrepresentation in real estate purchase and sale transactions, concealment of defects, deposit disputes, construction disputes, boundary and fence disputes, and much more. We also have a robust practice in real estate lending, and matters relating to lenders, mortgage brokers, hard-money lending, and the like. We also do creditor-side bankruptcy, including relief-from-stay actions.
If you can conceive of it, we've probably handled it.
On the transactional side we handle For Sale By Owner (FSBO) transactions, leasing, landlord-tenant on the landlord side, loan documentation, and much more.
To find out if we handle problems such as you might be facing, give us a call to discuss it. A friendly welcome awaits you.

Our attorneys have experience in all aspects of pre-bankruptcy work outs and negotiating or litigating against debtors, other creditors, or trustees while the debtor is under bankruptcy protection. Whether it is an adversary proceeding for non-dischargeability, a motion for relief from the automatic stay, or simply filing a proof of claim, our attorneys are ready to assist you in recovering your claim.
Calling us or filling out the short form in the right hand column could be the difference of recovering zero or adding zeros to the amount of your payments from the debtor.

LANDLORD/TENANT

At the firm, we assist landlords and tenants from the beginning to end, , whether it be negotiation of the lease, to an audit, payment dispute, leasing dispute, or eviction (unlawful detainer). We have defended property owners in tenant litigation, evicted tenants after foreclosure sales or for failing to abide the terms of their lease, defended wrongful eviction suits (often as part of a foreclosure defense lawsuit), as well as habitability suits brought by tenants.
Our capable attorneys are experienced litigators, with jury trial, court trial, arbitration, appellate and mediation experience.
Oftentimes parties believe that leasing forms are standardized with cookie-cutter provisions. Our experience with the more commonly published forms, both residential and commercial, has taught us where the pitfalls for the unwary lie, from inclusion (or exclusion) of attorney fee provisions, audit provisions, common area charges, to the basics such as how "premises" is described.
