The Law Offices of John K. Hinely serves the Northern California counties of Butte, Colusa, Glenn, Lake, Mendocino, Sutter, and Yuba; with offices conveniently located in Colusa and Lake County. Mr. Hinely is focused on criminal law, including Felonies, Misdemeanors, DUI, and Traffic cases. Mr. Hinely recognizes that the legal process can be overwhelming and present a difficult time for both you, and your family. With that in mind, he will ensure you understand everything going on in your case and make the process the least stressful as possible. As always, consultations are FREE.

Mr. Hinely has handled well over 1000 cases. He has been successful in Motions to Suppress Evidence; Motions to Strike Priors; Motions to Compel Evidence; Motions to Disclose Peace Officer Personnel Records; etc. After having completed a thorough investigation of a Vehicular Manslaughter case, and presenting the information to the prosecution, the prosecution moved to dismiss the case due to lack of evidence, even before trial. In a Child Endangerment case Mr. Hinely filed a Motion to Suppress Evidence based on a violation of the U.S. Constitution. That motion was granted and all evidence of the search of the residence was excluded, leaving the prosecution with no alternative but to dismiss the entire case. Is your firm willing to help a client with one discrete part of a case, without taking on the whole case?

The Law Offices of John K. Hinely will assist persons seeking limited representation on certain issues. However, the importance of full legal representation cannot be emphasized enough when someone is facing the legal system.

What are your policies about dividing work within the firm to make the process most cost-effective for the client?

At the Law Offices of John K. Hinely it is our policy that if you hire Mr. Hinely; then Mr. Hinely will be working on your case and appearing in court on your behalf. We do not "farm" out cases to other attorneys, etc. You came into our office expecting a specific attorney to represent you and this is what we will provide you. Of course office staff may be used for administrative functions, but legal functions will be completed by Mr. Hinely.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

Although mediation and arbitration are not typical methods used in Criminal Defense; negotiations are critical to any criminal case and Mr. Hinely will actively pursue an alternative form of resolution for all clients.

Does your firm provide pro bono legal services or otherwise participate in your community?

The Law Offices of John K. Hinely is proud to support the community. This includes supporting various youth organizations; high school sports; and providing Pro Bono services to various people in the neighborhood.

Mr. Hinely is not a general practitioner; rather he is focused on criminal law, including Felonies, Misdemeanors, DUI, and Traffic cases. This allows him the opportunity to serve your interests with more knowledge and understanding of the specific issues involved. Mr. Hinely is a local practicing attorney and is not a chain firm that will simply farm your matter out to another independent attorney.

What is your firm's point of view regarding clients educating themselves on legal issues?

The Law Offices of John K. Hinely encourages clients to familiarize themselves with legal issues. However, often times people can be easily mislead by reading the internet, or speaking with friends and family who may have been through the legal process in the past. Laws are constantly changing and one facing the legal system should always consult an attorney.

Is your firm willing to review documents prepared by clients?

The Law Offices of John K. Hinely will conduct document review. However, there is a fine line between document review and legal representation. Everyone should understand that because an attorney reviews your documents, he/she will not be appearing in court with you. Thus, you may still be placed in a position of presenting a legal argument to a judge on your own behalf. Full representation is always recommended.

Is your firm willing to coach clients who want to represent themselves?

The Law Offices of John K. Hinely strongly urges against representing yourself in court and thus does not "coach" clients. Even after speaking to an attorney, you may still be placed in a position of presenting a legal argument to a judge on your own behalf, and will be held to the same standard (no special treatment) as an attorney.

John Hinely

After 14 years in Law Enforcement and working as a Paralegal for the Public Defender, Mr. Hinely was determined to become a Criminal Defense Attorney. After graduating from law school, Mr. Hinely opened his private practice, while also serving as a Contract Public Defender. During this time, Mr. Hinely recognized that the Public Defender Offices were extremely impacted and forced to handle many more cases than could be appropriately researched, investigated, and prepared for court. Subsequently, Mr. Hinely made the decision to terminate the Public Defender position and focus on his private practice, providing clients with the time and care needed to appropriately prepare their case for court.
