Firm Overview

Our divorce lawyers at the Bay Area Family Law Center are motivated by helping clients through the most difficult times in their lives. We strive to do what is best for you and your family.

Our team consists of highly skilled litigators with the prowess to effectuate settlement whenever possible to minimize any financial or untimely straining from unnecessary court battles. We pride ourselves on liberating our clients from the chaos of divorce and back into moving forward with their lives with a rediscovered sense of peace.

We know that nothing is more important to you than safeguarding the wellbeing of your children. As child custody specialists, we are here to protect your family dynamic and aggressively do all that is needed to ensure that you get a proper timeshare with your children. We specialize in helping clients prepare for Family Court Services Mediation. We know the Child Custody Recommending Counselors as well as the County Judges. We are here to zealously fight for our clients in order to get their children out of difficult situations and back into stable environments.

Our family law attorneys are also child support specialists. Our team has the knowledge, experience, and prowess to aggressively represent our clients in any child support matter. The Department of Child Support Services works with our attorneys to guarantee that our clients get a fair result. We accommodate our clients by presenting a compelling case to achieve the proper level of child support.

Our spousal support attorneys specialize in working with the often-misconstrued Family Code Section 4320 factors. During litigation, we use Dissomaster to calculate the proper level of spousal support. However, at the time of a Divorce Judgment, we shift our focus towards presenting a solid case for our clients to demand that the right amount of support is paid. This is a complex issue with many layers, and we are a team with the experience level and tenacity that you will need in your corner.

Our Walnut Creek divorce attorneys also specialize in the dissolution of same-sex marriages. We support the LGBT community and have affiliations with Lambda Legal and the National Center for Lesbian Rights (NCLR). Today there is no such thing as gay divorce. Thanks to the California Legislature, there is only divorce. Nevertheless, it is often important to have an attorney who knows how to help litigate the issues unique to the LGBT community. Our attorneys diligently stay up-to-date on the ever-changing laws for the LGBT community and we are prepared to help you and your family get through the divorce process or dissolving your domestic partnership.

Our attorneys are Certified as Family Law Specialists by the California State Bar Association. We are also recommended by the Better Business Bureau, by Avvo.com, and are peer-endorsed by family law attorneys in the Bay Area.

Here at the Bay Area Family Law Center, your family comes first.

Our attorneys encourage collaborative parenting whenever possible.

Divorce

Divorce occurs at the worst times imaginable. There is a better way to get on with your life. Our Certified Family Law Specialists specialize in getting clients through their divorce.

Divorce has never been easy. People feel abandoned, angry, alone, and all too often they can be vengeful. Bank accounts get closed, funds transferred, credit cards overcharged to their limits. And, of course, children all too often get caught in the middle of it all. There is a way to ensure that your children transition to happy homes, to receive your share of the joint property, to not overpay on your support, and to get this painful time in your life over and completed. Our firm will help you move onto the next chapter in your life.

Divorce Mediation

Our Mediators specialize in working with both parties to inform them of the law and get the parties quickly through the divorce and custody processes in a non-adversarial manner.

Our attorneys are highly effective litigators who fight for the right results. We fight for fair property division and fair levels of spousal and child support.

What distinguishes your law firm from others?

We believe that we can make a real difference by helping people when they are going through one of the worst moments of their lives, the dissolution of a family. We ensure that our clients get the results they seek, without spending more than necessary.

What is your firm's point of view regarding clients educating themselves on legal issues?

Going through a divorce can be hard. Not only are you dealing with emotional overload, but you also need to deal with the court system. We believe that everyone should have a basic understanding of of what is involved in any family law issue. There are a lot of resources available to help educate yourself. Our attorneys frequently write articles and blogs on our website (www.wcfamilyattorney.com) pertaining to commonly asked questions.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

If you and your soon-to-be-ex are on speaking terms, you should discuss the possibility of family law mediation. We understand that sometimes, clients are not on good terms with their ex-spouse, therefore our mediators will help both parties and inform them of the law to help get the parties quickly through the processes in a non-adversarial manner.

Is your firm willing to help a client with one discrete part of a case, without taking on the whole case?

Yes, we can represent you on what's known as a Limited Scope basis. You will sign a Notice of Limited Scope retainer, which allows us to represent you in court just for that one issue. If you need us to represent you beyond the limited scope, we can sign another retainer with you.

Samuel Welles is the probate attorney and the newest member of the Bay Area Family Law Center. Prior to joining this practice, he worked for a small business litigation firm in downtown San Francisco. He attended law school at night at the University of San Francisco School of Law while working for a boutique probate, tax, and estate planning firm. While at USF, he won the CALI Award for Federal Income Taxation and participated in the Intensive Advocacy Program - an oral-advocacy and trial skills workshop. He has extensive professional experience in Probate, Trusts, and Estates; Business Entity Transactions; and Tax Planning.

Prior to his career in law, Samuel attended Bates College in the beautiful state of Maine. As a founding member of the Bates College Musician's Union and its first treasurer, he got his first exposure to accounting practices through maintenance of the organization's balance sheets and his first oral advocacy experience in representing the organization in hearings before the Student Activities Budget Committee. In addition to an Economics minor, Samuel successfully completed an oral defense of his Honors Thesis in Music Composition which premiered at the 2007 Mount David Summit.

Samuel thoroughly enjoys using his law license to help clients navigate probate, working through estate disputes, or by avoiding the probate process altogether through the careful and deliberate process of estate planning and trust administration.

Outside the law, you can find him on the disc golf course and listening to old vinyl at the home in Oakland he shares with his lovely girlfriend and their two cats, Moose and Dusty.

Indy Colbath

Indy Colbath is a licensed California attorney who has focused the entirety of her legal career on family law issues, including: divorce, annulment, child custody, child support, spousal support, property division, and domestic violence restraining orders. Indy has a breadth of courtroom experience she relies upon when assessing her clients’ family law matters, as well as strong relationships with the local legal community and bench. Indy has effectively represented her clients in an array of complex family law litigation, many of which involving high net worth individuals. Even though Indy has a passion for courtroom advocacy, she understands that every family law case is different, and in certain matters it is more appropriate to settle than it is to engage in costly litigation. Indy consistently advises her clients of the costs and benefits of compromising versus fighting in court. But in matters that are litigated, Indy vigorously and effectively represents her clients’ interests. In addition to her focus on outstanding advocacy, Indy strives to provide excellent service to her clients by making herself consistently approachable and available. Indy personally supervises each of her cases from their outset to completion and keeps her clients well informed of their case status.

Indy’s passion for advocacy was ignited in college when she became a certified peer counselor with WEAVE (Women Escaping a Violent Environment) in Sacramento. She spent two years working as a crisis line counselor for callers who were victims of domestic violence and sexual assault. After college and prior to law school, Indy was a law clerk with the Legal Aid Society’s Dependency Program in Martinez, which represented parents and children in dependency proceedings. Because of these experiences, Indy is able to approach high conflict cases involving intimate partner violence and or child abuse with specialized knowledge and sensitivity. Indy understands and is able to effectively advise her clients of the potential legal consequences in any family law matter when there are allegations of abuse, whether made by or against her clients.

Indy is a Contra Costa County native; she grew up in Pleasant Hill and attended College Park High School. She earned her Bachelor’s Degree from the University of California at Davis where she graduated with honors, majoring in Sociology with emphasis in Law and Society. Indy attended law school at California Western School of Law in San Diego, after being admitted with a full-ride scholarship. Indy graduated in 2013 with her Juris Doctorate, and was admitted to the State Bar of California in December of 2013.

In 2016, Ethan passed the California State Specialist Examination and became a Certified Family Law Specialist. Ethan aggressively represents clients in all conventional family law matters, as well as dissolution of Registered Domestic Partnerships and Same-Sex Marriages. Ethan has the unique ability to work closely with his clients on a personal level, ensuring that the clients get the results they seek.

Ethan is also one of the few Contra Costa Divorce Mediators and has a reputation for working with divorcing couples to help do what is best for the client's, their children, and the community estate.

Ethan created the Bay Area Family Law Center, Inc with the belief that he can make a real difference by helping people when they are going through the worst moments of their lives. Ethan's altruistic goal is to help clients get through the complicated divorce and/or child custody process without spending a single dollar more than necessary on attorney's fees and costs. While other attorneys are interested in the business of law for making money, Ethan is in the practice of law for the love of the services that he provides to better his clients' lives.

Samuel Welles
