The firm was established in 2006 by David H. Baker, an attorney with over 35 years of experience in the area of safety law. A nationally recognized expert in product safety law, Mr. Baker has handled over two hundred recalls; he has been involved in numerous civil penalty negotiations and he has first chaired five major rulemakings before the CPSC. He is a frequent speaker on product safety law issues in the U.S. and Europe and publishes a product safety newsletter for clients, entitled The Product Safety Report. See Firm Newsletter page on website above. Mr. Baker also serves as an Adjunct Instructor on product safety law at Catholic University Law School.

Mr. Baker also handles transportation law matters including motor carrier regulation (contracts, loss and damage claims and logistics issues) and hazardous materials regulation (special permits, advisory opinions and packaging issues). Mr. Baker previously taught transportation law at the University of Maryland, University College, College Park, Maryland, and at the Military Traffic Management Command, Falls Church, Virginia.

Mr. Baker co-chairs the American Bar Association ("ABA") Committee on Consumer Products Regulation, is Past President of the International Consumer Product Health and Safety Organization ("ICPHSO") and is Past President of the Association of Transportation Law, Logistics and Policy.

David H. Baker has been practicing law in Washington, D.C. for over 35 years, focusing on the areas of safety law and transportation law. In the product safety area, Mr. Baker has been lead counsel for industry in five rulemakings before the CPSC and regularly represents clients before the CPSC in Section 15 reporting cases, recall actions and civil penalty proceedings. He also regularly appears before Health Canada/Sante Canada on behalf of manufacturers of regulated products in that country.

In the food and drug area, Mr. Baker provides assistance to U.S. companies and foreign establishments, that manufacture, import or distribute medical devices. He regularly assists companies with compliance with the medical device reporting requirements.

In the transportation area, Mr. Baker regularly appears before the Pipeline and Hazardous Materials Safety Administration ("PHMSA"). He provides assistance to companies that offer, ship or transport hazardous materials, including obtaining special permits and approvals for explosive, flammable and toxic materials. He also represents manufacturers of UN packaging on special permits and letters of interpretation before PHMSA. He also represents companies in regard to inspections, exit briefings and civil penalty matters before PHMSA. Mr. Baker has served as counsel to several industry groups on rulemaking proceedings before PHMSA.

He also regularly appears before the Federal Motor Carrier Safety Administration ("FMCSA"), Mr. Baker provides assistance to motor carriers in regard to licensing, exemptions and civil penalty matters before the agency. He regularly counsels companies on motor carrier contracts, 3PL contracts and loss and damage claims. He has also served as counsel to several industry groups on rulemaking proceedings before FMCSA.

Mr. Baker previously served as the Executive Partner in the Washington, D.C. office of an AM LAW 50 law firm and on the Executive Committee of an AM LAW 200 law firm. In 2006, he decided to pursue a career goal of establishing his own firm focused on safety law.
