If you are facing a DUI charge, the evidence may seem overwhelming. You should rarely just plead guilty to such a charge without talking to a lawyer first. There are a number of factors, complications, and details that a good attorney can use in your defense, often successfully. For example, there are a large number of substances or medical conditions that can cause false breathalyzer results and blood testing is error prone. In addition, there are specific procedures officers should follow during a roadside investigation; however, these procedures are often ignored. A DUI incident can have two components; the legal process (such as arrest or citation) and the DMV procedure (such as license suspension). Navigating these dual systems can be complicated and frustrating but we can help.
A DUI conviction in California is a serious matter. California law carries some of the harshest penalties for DUI offenses and California's dual system for dealing with DUI allegations creates multiple layers of complex legal issues that only an experienced DUI attorney is prepared to effectively address. These laws are intended to reduce the number of accidents and fatalities resulting from drunk driving. However, they were also written to protect the legal rights of defendants and, with experienced representation from a qualified lawyer, there are a number of possible defenses which can mitigate the severity of a conviction or even avoid conviction entirely in appropriate cases.
