When arrested for a DUI two things happen:
1. You will be charged with the crime of DUI in court. (California Vehicle Code sections 23152(a) & 23152(b).)
2. The DMV will automatically suspend your license if you do not request a hearing within TEN days. If a hearing is requested within ten days, you will be granted a hearing to determine whether a license suspension will be imposed.

When you hire the Law Offices of Benjamin Cates we will fight for your rights not only in Court, but also in person at the DMV. Our office will gather all evidence, including audio or video recordings, and be able to utilize this evidence to question all witnesses including the police officer who made the arrest. Ben Cates

Before defending the freedom and rights of his clients in the California court system, Mr. Cates served our country and fought for the Constitution as a United States Marine. He served his country as a U.S. Marine for six years and was honorably discharged as a Sergeant. Mr. Cates takes special pride in defending Veterans and Active Duty Military personnel.

Mr. Cates continues to defend the Constitution in every case as he defends individual's rights in the criminal justice system. Mr. Cates earned his Bachelor's degree from the University of Redlands and his Juris Doctorate from California Southern Law School.
