Child Support: In New York, both parents have an obligation to support their child(ren). There is a statutory formula to calculate the amount of basic child support each parent is legally obligated to provide for their child(ren). In events of a divorce, or where the parents are not living together, the non-custodial parent is directed to pay his/her share of support to the custodial parent. In addition to basic child support, parents can be obligated by the Court to pay their pro-rata share for additional expenses, such as health insurance, extracurricular activities, child care, etc.
Maintenance: Maintenance or spousal support refers to the money provided by the monied spouse to the non-monied spouse for his/her support. In situations where one spouse was the bread winner or supporter of the family and the other spouse was either a stay-at home parent and/or does not earn sufficient income to support himself/herself, there could be an award of maintenance to allow for the non-monied spouse to receive additional income post-divorce. Maintenance can be for a certain time period or lifetime, depending on the factors, including financial capabilities of the parties, age and health of the parties and duration of the marriage.
Equitable Distribution: Equitable Distribution refers to the division and apportionment of marital property between the parties. Equitable does not mean equal, and it is for this reason that it is imperative to carefully classify each and every asset as either marital or separate, and the marital portion of each. All types of property and assets are subject to division including real estate, bank accounts, securities, pensions, retirement accounts and even advanced degrees and enhanced earnings.
Often spouses decide that a divorce is not beneficial to them and they opt for a legal separation and separation agreement. A major benefit to this avenue as opposed to a divorce is that it allows for one spouse to remain on the health insurance policy of the other. A separation agreement is very similar to an agreement for a divorce, however it does not dissolve the marriage.
