Hiring A Probate Attorney

When To Probate

When someone who owns property in California dies, a California court may need to oversee the transfer of property ownership from the decedent's estate to the heirs, regardless of whether or not the individual has a will. In TAXATION, I began my career working for the IRS and I understand it from the inside out. I have a Masters Degree in Taxation and stay up to date on the changes in the Tax Law that specifically apply to your problems.

In PROBATE, I am experienced to get through the probate process as quickly as possible so that you can get your money and property as soon as you can.

For ESTATE PLANNING (wills and living trusts), I protect your assets from undue taxes so you can pass more along to your family. I have prepared estate plans for business owners, single persons, married couples with kids and without kids, for grandchildren, for those whose kids have special needs, for U.S. citizens and non-citizens, for small estates and for large estates, and for blended families.

In BUSINESS, you and I will discuss what business structure works best for you. I form corporations, limited liability companies (LLCs) and partnerships. I write contracts of all kinds. I review documents you already have and can explain to you what they mean. I act as your outside general counsel as-needed.

Mitchell A. Port

I am an attorney in Los Angeles focusing in four areas of law: Tax Controversies, Probate, Estate Planning, and Business Transactions. I began my career as a lawyer with the IRS in Washington D.C., where I worked on tax collection and litigation matters. I later worked at two noted local law firms where I further developed my tax controversy skills and represented clients in estate planning, California probate, and business transactions. I am a former Internal Revenue Service revenue/collection officer.

After gaining the skills, knowledge, and experience equal to that of partners at a law firm, I founded the Law Office of Mitchell A. Port. As a sole practitioner, I provide each client with the specialized skills, experience, personal focus and hands-on attention they need at cost-effective rates.

I represent individuals and businesses with cases pending before the IRS, the U.S. Tax Court and Superior Courts throughout California. I handle estate planning matters and deliver both non-litigation and litigation probate services as well as trust administration services. As a business transaction attorney, I provide legal advice and representation on business formation, business organization, business transactions, and business tax matters.

I translate all legal and tax jargon into plain English for my clients when dealing with tax controversy cases in the U.S. Tax Court and problems with the Internal Revenue Service, while strategizing during a California probate case, and when discussing estate tax planning so that every client I work with is informed, up-to-date, aware of case developments, and able to make educated and informed decisions. A California attorney since 1982, I am licensed to practice before the 9th Circuit Federal Court of Appeals, the U.S. Tax Court and state courts throughout California. I earned an L.L.M in Tax Law from the University of San Diego School of Law and a J.D. from Southwestern University School of Law. I graduated from the University of California at Los Angeles with a B.A. in Political Science.

I am a pro bono speaker for many professional accounting associations, service and non-profit organizations, as well as a writer whose articles have been published in several trade publications. I serve or have served on the board of directors of several non-profit organizations. I am an avid and skilled cyclist who has ridden throughout the eastern seaboard and on long rides from California to Mexico. I have also backpacked in half a dozen national parks, the Sierra Nevada Mountains, and Canada. I am currently learning to play the piano so I can share this interest with my two daughters.
