Firm Overview

Our firm focuses on personal injury, wrongful death, Truck Accidents, and Social Security Disability Example cases Our client from 10 to 12 foot height while on the job, injuring his knee. While on crutches from the knee injury, he developed a back problem. In addition to his workers compensation claim, he had a claim against another crew whose negligence contributed to the accident (This is a 3rd party claim). Right before the deadline to file suit, his attorney got off the case, saying he had no case. His workers comp attorney told him to call us. We filed suit and eventually settled the case for six figures. A number of obstacles that had to be overcome, including proving that the back condition was caused by the accident.

What are your policies about dividing work within the firm to make the process most cost-effective for the client?

We delegate as much as possible to paralegals. This helps keep fees down cases that are billed hourly. It does not affect the bill as much on contingency fee cases such as personal injury and Social Security Disability. We do offer less than the normal 1/3 contingency fees on personal Injury cases that w e settle rather than take to trial.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

We mediate almost every case as it is mandatory in most SC Counties. We occasionally use arbitration.

Does your firm provide pro bono legal services or otherwise participate in your community?

We provide pro bono services that are referred to us by the South Carolina Pro Bono Program

What distinguishes your law firm from others?

Our expertise in Personal Injury law and trial law in general.. We have taught courses for other attorneys in these areas. We also offer client first fees, charging less than the standard one third if we are able to settle Personal Injury Cases prior to trial.

What is your firm's point of view regarding clients educating themselves on legal issues?

We think it is good for clients to educate themselves on legal issues. We have written a number of books and reports to help individuals with legal issues educate themselves. However, it is our belief that the main purpose of this self study is to help the individual recognize whether he/she needs an attorney, and to help the individual find the right attorney. When you file a serious case, you need an attorney. You cannot do it yourself.

Having worked as a prosecutor for eight years, David F. Stoddard went to work in the firm Waldrep and Stoddard in 1994. In 2006, he started the Stoddard law Firm, concentrating in trial law including personal injury law, criminal defense, and family law.
