My firm is committed to providing personal service to clients in the areas of wills, trusts, and other estate planning as well as handling administration of estates and trusts. I have extensive experience in trust litigation and can help ensure your rights as a beneficiary are represented.

I also advise clients concerning elder law issues and represent clients who have business planning or business litigation concerns.

My goal is to provide high quality, individually tailored, legal services in a caring and efficient manner to those who need help in my areas of expertise. No two clients face identical circumstances and no two clients share identical goals; I work to tailor each representation to the complete needs and wishes of the client.

Estate Planning
The Law Office of Justin M. Gilbert is a specialized in estate planning, including elder law, probate, trust litigation, and trust administration.
I have extensive experience drafting tailored estate planning documents, unique to the needs of each client, including:

I have experience structuring estate planning documents to allow clients to continue to qualify for Medicaid and Veterans benefits. In addition, I have experience drafting trusts for various family dynamics, including divorced clients, high net-worth clients, small estates, and non-citizen clients. I also have extensive experience in trust administration and trust litigation. As a trustee, I can work with you to ensure you are complying with the law and the terms of the trust, and can protect you from any personal liability. As a beneficiary, I can ensure your rights are protected, and that you receive the benefits that the settlor intended you receieve.

How did your firm decide on the primary area of practice(s)?

I wanted to practice where I could have a positive influence on people in concrete ways. I like coming up with creative solutions to help individuals solve problems.

What is your firm's point of view regarding clients educating themselves on legal issues?

I believe that clients should learn as much as they can about the legal issues they face. While it is unlikely that they will have the time and training to bring their level of understanding up to that of an attorney who has developed expertise in the area of the law in question, study of the issues by the client would make for a more effective discussion with the attorney about how to proceed with and resolve the particular legal matter in question.

Having had a wide exposure in number of legal disciplines such as litigation and employment law in addition to his extensive knowledge of estate and elder law, Gilbert prides himself in listening and responding to the needs of his clients. His exceptional legal skills are demonstrated as he provides practical solutions for sometimes complex and far-reaching personal and financial issues.

Justin received his Juris Doctor from Santa Clara University School of Law, where he served as a staff member and technical editor for the prestigious Santa Clara Journal of International Law. He gained valuable experience as a Fellow at the Santa Clara Broadband Clinic and prior to opening his own practice, Gilbert worked at the law firms of Packard, Packard & Johnson and Porter | Scott.

A proud member of the State Bar of California, Gilbert volunteers at the Voluntary Legal Services Program (VLSP), providing no cost legal services to low income individuals while maintaining his status as a member of VLSP's Advisory Committee.
