Firm Overview

I am an experienced attorney who devotes my practice towards helping clients, just like you, regain financial control in their lives. I understand the economic problems facing individuals and families today and I know how to use the current laws to help my clients obtain a "fresh start."

Kyllander Law was established in San Diego in 2006 and incorporated in 2009. In June of 2009, the firm relocated to Orange County close to where I was born and raised and where my parents still reside.

Kyllander Law Case Studies: Chapter 7 Bankruptcy

Problem: Jenny was a 42 year old recent divorcee. Her divorce settlement had left her with 50% of the community debts and her $40,000 per year salary wasn't enough to cover the bills. One of her credit card companies had filed a lawsuit against her and she was worried a wage garnishment would push her over the edge.

Solution: Jenny contacted me for assistance. I recommended that Jenny file for relief under Chapter 7 of the Bankruptcy Code.

Result: By filing bankruptcy, Jenny was able to put an immediate stop to the lawsuit against her without any of her wages being garnished. In addition, in less than three months, 100% of her unsecured debts were discharged through the Chapter 7 bankruptcy process. Jenny is now able to maintain a comfortable lifestyle and is enjoying a true fresh financial start!

Chapter 13 Bankruptcy

Problem: Tom was working two jobs and his income was above the median for the state of California. Unfortunately, Tom made some poor financial decisions which have left him with $60,000 in unsecured debt and he owed an additional $20,000 to the IRS in prior year income taxes. The monthly payments had become more than he could handle and the creditor phone calls were driving him crazy.

Solution: Tom found Kyllander Law online and attended a free webinar on bankruptcy basics. He then scheduled a consultation with me and ultimately was advised that a Chapter 13 Bankruptcy would help him reorganize many of his financial burdens.

Result: The Chapter 13 bankruptcy put an immediate stop to the harassing creditor phone calls and allowed Tom to repay his taxes and 10% of his credit card debt over five years. At the completion of his plan, the remaining credit card debt and interest (over $54,000) was discharged without any additional adverse tax consequences to him.

Services Offered For Fixed Fees?
In most cases, my legal fees for Chapter 7 cases will be around $1,000 to $1,500. Complicated cases may be more expensive but we will always be up front about our fees. The Bankruptcy Court filing fee in all Chapter 7 cases is $306. In addition, in all cases (Chapter 7 and Chapter 13), there are charges for the required Pre and Post Bankruptcy Credit Counseling which runs around $68 per individual filer and $87 per joint filers. Finally, we require all of our bankruptcy clients to obtain a current credit report from all three bureaus and the cost for those reports is $30 per individual or $50 per joint filers. Thus, your total cost of a Chapter 7 in most cases will be under $2,000.

The fees we charge for a Chapter 13 bankruptcy case will be higher than a typical Chapter 7 case. However, we typically only require $1,500 to be paid prior to filing the case with the remaining amount due to be included in your Chapter 13 plan. In rare cases we will require our attorney fees be paid in full prior to filing your case. The court filing fees in a Chapter 13 are $281 and the credit counseling and credit report fees are the same as described above.

How did your firm decide on the primary area of practice(s)?

Bankruptcy as a practice area really chose me. I had experience working in finance and as a dreaded collector, so my first job out of law school was with a creditor's rights firm representing mortgage companies in consumer bankruptcies. I have now found that working for and on behalf of debtors is a lot more rewarding.

What is your firm's point of view regarding clients educating themselves on legal issues?

Bankruptcy should be my client's last resort and I recommend that before they come to see me that they educate themselves on bankruptcy basics.

Kristine Kyllander

While going to law school at night, I worked full time for HSBC Auto Finance where I managed the bankruptcy department. I also completed an externship with the office of the United States Trustee for the Southern District of California. Following law school, I went to work as an associate attorney for a San Diego based national creditor's rights firm where I represented the interests of mortgage companies in consumer bankruptcies. Currently, I am using the knowledge I gained by working for creditors to benefit individuals and families who need personal financial relief.

I had a professional career working for finance companies for eight years prior to completing law school, so when I graduated I had a wealth of knowledge and real world experience that most of my fellow graduates lacked.

My strengths are that I am aggressive when it comes to helping people overcome creditor abuse and am not afraid to litigate the issues. My style is to be direct and upfront with both my clients and adversaries.

Personal interests:

I work a lot, but when I'm not working, if the sun is out you can usually find me playing golf and if not, I'm reading a good book.
