Case #2010-41602
The police stated that the accused accelerated quickly at a light then accelerated into a turn. The officer stated that the he observed the tires spinning during a u-turn, causing traffic to take caution. On cross examination it was revealed that the car alleged to have taken caution did not lock up its brakes or show indications that brakes were applied. The officer testified that it appeared that the car let of the accelerator but did not appear to dip forward. The officer alleged that the driver then turned off his headlights and parked the vehicle. It was revealed that the officer had already activated his lights to initiate the traffic stop prior to the allegations of the headlights going out. Testimony showed that pedestrian or vehicle traffic was not present when the headlights were alleged to be turned off. The motion to suppress was granted based on the fact that traffic was not affected by the u-turn and without a showing of danger the citation was invalid. Causing a driver to let of the accelerator was not sufficiently dangerous to justify the stop for careless driving. The DUI case was nolle prosequi'd and the careless driving citation was dismissed.

How did your firm decide on the primary area of practice(s)?

As a former prosecutor I became very familiar with criminal law and DUI defense. I always liked to defend people. I played football from elementary school to college and my job was to protect the smaller running backs from linebackers and defensive ends. As a defense attorney you protect your clients from the state and possible abuse of their rights.

What is your firm's point of view regarding clients educating themselves on legal issues?

I think it is helpful to have an understanding of the law and I try to provide information to the public. Free information should not be used as a substitute for legal advice considering the specific facts of your case.

Is your firm willing to review documents prepared by clients?

I do not have a problem with reviewing documents.

Is your firm willing to coach clients who want to represent themselves?

I am willing to do it when appropriate. An example is when someone receives a first traffic ticket. If they feel that the ticket was valid, I advise them that by taking a class they can avoid increased insurance premiums.

Kevin Pitts

I am a former Daytona Beach DUI prosecutor. At the State Attorney's office I handled thousands of cases including hundreds of DUI cases. As a former Florida prosecutor criminal defense attorney I have extensive litigation experience including pre-trial motion practice and trials.

I was raised in a small Midwestern town where nobody is a stranger. You care about everybody you deal with because you know them personally. You do not take advantage of others because in a small town your reputation is community knowledge.

As a former prosecutor I understand what gets a case reduced or even dropped. I also understand what concerns a prosecutor has when making decisions to reduce a case. I am often able to point out these issues and take steps to alleviate concerns and document the file to justify a reduction. I had an opportunity to observe a great deal of DUI litigation in Daytona Beach and use my past experience to effectively draft pre-trial motions to suppress evidence. My goal is not to increase litigation and drive up cost, but to use motion practice and trial when needed to obtain a favorable resolution. As an attorney who has had internet access my entire adult life, I am able to easily navigate online legal research and quickly find relevant case law. That allows me to quickly draft effective motions and keep cost down for my clients. I also understand that my job is to provide a service to my clients and I try to be available by giving out my direct phone number.

Personal interests:

I enjoy spending time with my family. I enjoy a variety of activities including, fishing, weightlifting, a saltwater fish tank, home improvement projects, college football and sometimes just acting like a kid with my kids and bounce from hobby to hobby.
