Firm Overview

We work to achieve creative, competent settlements for our clients' complex and emotional situations. We regularly TEACH lawyers and judges at continuing legal education seminars on trends in the law. We are all competent trial attorneys who know our way around a courtroom if we are unable to reach a fair, out-of-court settlement for our clients.

Mary Anne, Irwin, and I have EACH been practicing law for over 30 years. Mary Anne and I formed Day & Schiszik in 1998 and Irwin joined us as "Of Counsel" in 2005.

Example cases

1. I recently won custody for a mother who had serious mental health issues and was nonetheless able to obtain permanent alimony because the mother was incapable of holding a job. The court agreed that, although she was too mentally ill to work, she was nonetheless able to properly care for her children.

2. I have many cases involving complex "high end" property issues, such as business valuations, assets that are part marital and part non-marital and must be "traced" back to the source of the funds, etc.

Our initial consultations last 1 hour and serve as a detailed educational seminar. We charge $325 for that session.
Services Offered For Fixed Fees?
We charge a flat fee of $750 for an uncontested divorce in which there is a signed property agreement. Other than that, we charge for all time expended on your case.

How did your firm decide on the primary area of practice(s)?

I just fell into family law because that was a lot of the caseload in my first job. It turns out I was well-suited for it because I have a "laid-back" approach which tends to help calm down volatile situations and people. However, if I am unable to settle a case reasonably, my personality kicks over into a "now I want to beat you" mode.

What is your firm's point of view regarding clients educating themselves on legal issues?

I want educated clients, but want them to be aware that even tiny changes in facts can make their understanding of the law totally worthless. Much of family law is "art" and how nuanced a presentation can be made to the Judge or in mediation.

Is your firm willing to review documents prepared by clients?

Pleadings are generally easy to review. Attempts at drafting complex settlement agreements are usually "pound foolish" because it takes me longer to straighten out a poorly drafted "civilian" agreement than it takes me to draft a competent agreement from scratch.

Is your firm willing to coach clients who want to represent themselves?

I am willing to do that.

Keith Schiszik

Mary Anne, Irwin, and I have EACH been practicing law for over 30 years. Mary Anne and I formed Day & Schiszik in 1998 and Irwin joined us as "Of Counsel" in 2005.

My work on Capitol Hill taught me how to negotiate. My first legal job was in a "legal clinic" where I learned to be efficient in my work and developed systems and standardization of things to keep costs down for clients.

My strength is that I appear to be calm and laid-back on the outside, but am always analyzing the strengths and weaknesses of cases. Thus, lots of thought goes into my cases even if it is not apparent. My style is "collaborative" because a junkyard dog lawyer can do more harm to their client than good. Most judges "punish" lawyers who are not civil and professional to the court or to the other side. I am considered to be "Mr. Reasonable," but do not sell my client's down the river.
