Firm Overview

Fortenberry Legal provides estate planning and assists personal representatives (executors, administrators, trustees) with uncontested probate matters throughout Mississippi, Alabama, and Florida. Our goal is to provide quality, focused representation in the area of probate and estate planning. We offer value billing and free initial telephone consultations in probate and estate planning matters.


We also help startups and small businesses choose the right form of corporate entity, save money in taxes, and protect their corporate affairs. Our small business practice includes incorporation, LLC formation, mergers and acquisitions, confidentiality and nondisclosure agreements, employment and independent contractor agreements, and small business tax planning.


Fortenberry Legal was established in 2008 to provide focused representation of individuals and small business owners in matters involving business planning, estate planning, asset protection, and uncontested probate.

Services Offered For Fixed Fees?

Yes, I use a value billing pricing methodology. Clients are given an up-front quote so that they can make an informed decision about their legal affairs. If it takes me longer than anticipated to handle the work (assuming the scope of work doesn't change), then I bear that risk. I believe that this model encourages attorney efficiency and open communication between client and attorney.

How did your firm decide on the primary area of practice(s)?

Estate Planning: I chose estate planning and probate because it allows me to work with individuals in a strategic, non-adversarial setting to accomplish their goals. I know that the work I do adds value and leaves the client in a better situation than when they came to me. This can't be said about some other areas of law.

Small Business: My business work is divided between the for-profit and nonprofit sectors. On the nonprofit side, I helped set up a small nonprofit while I was in law school and have been hooked on nonprofit law ever since. I have found that helping nonprofit organizations structure their affairs is gratifying on a personal and professional level.

I like working with for-profit business owners because I am an entrepreneur at heart. As a small business owner myself, I know the financial and operational circumstances that many of my clients are facing. I enjoy working with small business owners in a strategic, non-adversarial setting to accomplish business objectives.

What is your firm's point of view regarding clients educating themselves on legal issues?

I believe clients should be pro-active in the management of their legal affairs. My goal is to educate the client as much as to advise them.

Is your firm willing to review documents prepared by clients?

I review documents prepared by clients on a case-by-case basis. In some circumstances, a quick review will be the most cost-efficient way to reach the client's goals. In other situations, it would be less time intensive (and therefore less expensive) for me to simply draft a document from scratch. In either case, my goal is to accomplish the client's objectives with as little expense as possible.

Is your firm willing to coach clients who want to represent themselves?

If there is something I can do to keep things simple for a client, I will. But I don't handle contested court matters, and state law typically prevents a client from representing themselves in probate proceedings. So this issue does not come up often in my practice.

I was previously employed as a tax attorney for Phelps Dunbar LLP and Balch and Bingham LLP.

My experience with large law firms taught me how not to practice law. Many big law firms view probate, estate planning, and small business work as second-tier, preferring to focus on other practice areas that are better profit centers for the firm. And because big law firms have so much overhead built into their fees, the cost to the client is often higher than it needs to be. I left the big law world to start my own practice because I believe that estate planning and small business clients are better served by a boutique law firm that can be more efficient and responsive to their needs.

Open communication between attorney and client is central. I use value pricing (flat fee business model), so my clients do not feel like they are "on the clock" for each question. I try to be accessible to my clients and respond same-day to questions and concerns.

Personal interests:

If I am not at work, I am usually at the soccer fields, at a church activity, or on vacation with my family. I spend almost all of my free time with my growing family, which doesn't leave room for much else.
