Firm Overview

My firm was established in 2008 with the intent of helping people in New Jersey who need good, caring representation in consumer bankruptcy or debt collection matters.

The focus of my firm is on helping New Jersey consumers who are in debt decide whether a Chapter 7 bankruptcy is right for them, and if so, to file for bankruptcy on their behalf. Another focus area is on defending against debt collection suits on behalf of New Jersey consumers who are being sued by debt collection agencies.

Example cases

A client had about $15,000 in credit card debt. She was no longer able to keep up with the minimum payments and stopped paying on her credit card bills. Creditors were calling constantly. After a consultation, it was found that she was eligible for a Chapter 7 bankruptcy. I filed the bankruptcy on her behalf and accompanied her to the meeting of creditors. Approximately two months later, she received a discharge of all her credit card debt - a fresh start.

Services Offered For Fixed Fees?

Yes, for most Chapter 7 bankruptcies, I charge a flat fee of $1,900. The client will be responsible for the court filing fee and for the small fees required for the two debtor counseling courses that are required as part of the bankruptcy. I will take installment payments of the flat fee and the court filing fee until they are paid in full prior to filing the bankruptcy papers.

If a case is more complex than usual because it requires litigation in bankruptcy court (with motions and court appearances), there may be extra fees involved. I do not charge extra to pull a client's credit report.

Bankruptcy
While I help people file primarily Chapter 7 bankruptcy cases, I also help people find solutions to their debt problems outside of bankruptcy.
Many people find that a Chapter 7 bankruptcy is right for their particular situation. However, there are some who are unable to file for bankruptcy at all, either because of the assets they own or because their primary debts cannot be discharged through bankruptcy. I work to help those who cannot file for bankruptcy by working toward non-bankruptcy solutions for their debt problems.

How did your firm decide on the primary area of practice(s)?

I chose bankruptcy because I enjoyed the class in law school and because it gives me the best opportunity to provide legal assistance to those who need it.

What is your firm's point of view regarding clients educating themselves on legal issues?

I think it's great when clients have the initiative and drive to discover information for themselves on legal issues. It can even help when discussing these issues with a lawyer, since there is already a familiarity with some of the legal concepts. During consultations, I am happy to clarify or expand upon a client's understanding of particular legal issues.

Is your firm willing to review documents prepared by clients?

While I am not willing to review legal documents prepared by clients, I do review lists of assets, income and/or expenses prepared by clients, since these are some of the things I need to prepare a bankruptcy filing on the client's behalf. It is actually much more efficient for me to prepare the legal documents than for the client to try and prepare their own legal documents and then to have me review them.

Is your firm willing to coach clients who want to represent themselves?

I am only willing to coach clients who want to represent themselves in a debt collection defense case, but not in a bankruptcy, so long as I am already representing that client in a bankruptcy case.

Jennifer Weil

My background is in the insurance industry, litigating insurance cases in New York City. I also have experience in the legal aid arena, primarily in the areas of Social Security disability, wills and employment law. I practiced law in Dallas, Texas before moving to New Jersey in 2000.

My work experience of working for a legal aid agency made me a better lawyer because it gave me direct contact with everyday people who just needed some basic legal help in order to move on with their lives.

My strengths are that I am able to provide quick advice and answers to legal questions and efficient legal representation. My style is one involving frequent communication. I use email and telephone calls to keep in contact with clients so that their questions are answered efficiently.

Personal interests:

I enjoy reading, photography, and watching the occasional good show on TV.
