What duties do health care providers owe you?

As a patient, when you turn to hospitals, clinics, nursing homes, or private doctor offices, you are trusting in the skills and expertise of medical professionals to provide proper diagnosis and treatment for your ailments. You also expect that your doctors and the medical assistants caring for you will meet the prevailing professional standard of care.

Under Florida law, the prevailing standard of care for a general health care provider is the level of care, skill, and treatment which, in light of all relevant surrounding circumstances, is recognized as acceptable and appropriate by reasonably prudent similar health care providers. FLA. STAT. § 766.102.

Specifically, for a physician, the prevailing medical standard of care is the duty to use the ordinary skills, means and methods that are recognized as necessary and which are customarily followed by those who are qualified by training and experience to perform similar services in the community or in a similar community. Sweet v. Sheehan, 932 So. 2d 365, (Fla. 2d DCA 2006). However, it is possible for a medical professional to be held to an even higher standard if she agreed in a contract to provide a specific level of care.
Product Liability
Companies have a duty to design, make and distribute a product that is reasonably safe for its intended use. Unfortunately, each year a number of Floridians are injured due to defective and dangerous products.
Fortunately, the parties responsible for injuries caused by such products can be held accountable under products liability laws. A law suit against parties involved in the manufacturing and supply chain of a defective product is known as a products liability case. Possible defendants may include manufacturers, testing labs, distributors, retailers, assemblers, component suppliers, or repairmen.

The main types of liability in a products liability case are: negligence, strict liability, warranty breach, and fraud.

Negligence Cases: failure to warn, marketing/advertising defects, negligent product design, negligent product manufacture, failure to test or inspect product, negligent failure to provide safety devices, breach of consumer protection laws

Strict Liability Cases: Design Defects, Manufacturing Defects
- Design defects are flaws in the intended design of a product that cause it to be unreasonably dangerous.

- Breach of Product Warranty Cases: Breach of Express Warranty, Breach of Implied Warranty

- Fraud and Fraudulent Concealment Cases: Fraud/misrepresentation occurs where the plaintiff relies upon a representation (such as a verbal statement, or a product label) that proves false and harms the plaintiff. The plaintiff would have a fraud claim and perhaps a warranty claim as well.

- Manufacturing defects: When the product does not conform to the specifications of the designer or manufacturer.

Jeffrey R. Davis has practiced in the area of Plaintiff's personal injury, wrongful death and medical malpractice exclusively. After working as an associate in a Plaintiff's injury firm Mr. Davis formed his own practice in 1997.

As a practicing lawyer, Jeffrey R. Davis has served on various committees of The Florida Bar, including several grievance committees and committees on the unauthorized practice of law. He has held memberships in several local, state and national lawyer organizations and is admitted to practice law in both Federal and State Court.

    Jeffrey R. Davis grew up in Massapequa, Long Island, New York. He attended college at the State University of New York at Stony Brook where he graduated with high honors in 1983. Mr. Davis then attended law school at the University of Miami School of Law where he graduated in 1986. He was admitted to The Florida Bar that same year.

Olga Porven

Olga Porven, a Miami-Dade County native, began her legal practice as a public interest attorney serving the impoverished populations of Miami-Dade County. As an Equal Justice Works Fellow and a Clinical Supervisor, she founded the Elder Law Division of the University of Miami School of Law Health and Elder Law Clinic. She represented individuals in matters concerning Social Security disability, fair housing, immigration, and probate matters.

In addition, Ms. Porven is a former trial defense attorney of a well-known statewide law firm. As a defense attorney, she gained experience in all areas of civil litigation and obtained invaluable insight into defense strategies and tactics.

Olga Porven is fluent in Spanish. She joined the firm in July, 2012.
