John Zimmer founded this firm following his association with the Bogue family, who has been practicing law here in South Dakota for over a hundred years. I joined the firm in 1992 and became a partner in 1996. Currently our firm has offices in both Sioux Falls and Parker, South Dakota. We are proud of the deep South Dakota roots of this firm.
In the case of Schuh v. Heck Brokel, tried in Butte Country, South Dakota, a negligent truck driver struck our client while they were riding in a car. We were able to secure a $920,000 settlement for our client in that case.
We represented a client in a will contest case who alleged that there was undue influence in the matter of the Estate of Kenneth Thomas Duebendorfer. We took the case all the way to trial, with the jury ultimately siding with our client, returning over $400,000 back to the Estate of the deceased. The verdict was appealed all the way to the South Dakota Supreme Court, where they affirmed the original verdict in favor of our client.

After working as the Turner County States Attorney for almost ten years, I knew my heart belonged in private practice.

We will review any document a perspective client brings to us. We handle numerous business litigation cases, so documents provided by our clients have been instrumental in many of our legal victories.
I have been on both sides of the courtroom, trying cases as the State's Attorney and defending clients against accusations made by the state as a criminal defense attorney. We will work with clients who wish to defend themselves, but we do not advise it.
I joined Zimmer & Duncan, now Zimmer, Duncan & Cole, as an associate attorney right after graduating from law school in 1992 and was made partner in 1996. Since then, I have also worked as a part-time prosecutor, having been appointed once (1995) and elected twice (1996, 2000) to serve as the Turner County States Attorney. I chose not to run for reelection in 2004 to focus on private practice law for Zimmer, Duncan & Cole.
Being raised on a farm has instilled in me a tremendous work ethic that powers everything I do. Having worked on both sides of the courtroom as a defense attorney and as the States Attorney allows me to truly see both sides of a case. That ability has served me well throughout my legal career.

I love driving my tractor on the farm I grew up on which my parents still own to this day. I would love to move back to the farm one day, but my wife Kim isn't so sure.
