We front the costs of litigation so there is no risk to you - we do not ask you to pre-pay costs or pay interest on the costs. Our fee is based on a contingency fee that ranges from 20% to 33.33% of the compensation recovered, dependent on the type of case.

For workers' compensation cases, our fees are set by statute at 20%. The 20% and costs (doctor's fees for depositions, filing fees, etc.) are recovered out of the final settlement. In the extremely unlikely event of no recovery, we receive no fee and do not recover costs.

For jury cases (construction "third party", automobile, trucking, nursing home, maritime, FELA, motorcycle, premise and product liability) our fee is 33.33% of the compensation recovered. Once again, there is no recovery by our firm unless we win.

How did your firm decide on the primary area of practice(s)?

The Horwitz family of premier Chicago trial attorneys have continued a tradition begun by grandfather, Jacob W. Horwitz, of representing individuals against corporate wrongdoers and insurance companies who routinely take advantage of those who are injured. Horwitz, Horwitz & Associates has never represented corporate interest and never will.

What experience or education distinguishes your lawyers from others?

Clifford Horwitz heads the lead trial team at Horwitz, Horwitz & Associates. He has won every case that he's taken to trial for the last 20 years. Over one-quarter of those verdicts have been record-setting jury verdicts.

Mitchell Horwitz leads the workers' compensation team with over 35 years of experience as an attorney handling work related injuries. Mitchell was named as one of the Top 10 Workers' Compensation Lawyers in Illinois among his peers through a survey conducted by LeadingLawyers.

In 2010, Horwitz, Horwitz & Associate's attorney, Marc Perper, convinced the Supreme Court of Illinois to reverse an unfavorable appellate court decision in 2010. The Illinois Supreme Court aggred with Marc that when an employer fires an indivudal while the person is on Temporary Light Duty, regardless if the firing is for 'cause' that the employer must reinstate weekly disability benefits. Hundreds, if not thousands, of working Illinois men and women will benefit from Marc Perper's work.

Workers' compensation attorney, Mark Weissburg wrote the book, "How to Win a Workers' Compensation Claim in Illinois." The book covers topics like the secrets that insurance adjusters do not want you to know, three basic rights that you have under the Illinois Workers' Compensation Act (IWCA), amendments to the IWCA, and many more useful tips.

In 2012, the lead trial team at Horwitz, Horwitz & Associates won the largest verdict in Illinois history for compensatory nondeath according to the Illinois Jury Verdict Reporter. The $64 million verdict was awarded for an injured ironworker who fell and was left paralyzed from a jobsite accident. The American Association of Justice branded Clifford Horwitz, Jay Luchsinger, and Michael Carter as "masters in the profession." Less than two years after receiving this verdict, the lead trial won another record-setting jury verdict for a non-amputation hand injury. The $5.745 million verdict was awarded to a carpenter who was left injured after a jobsite accident.
