Divorce is a difficult time. But, perhaps the most difficult aspect of divorce is deciding what happens to the children. We approach the issue from a "putting children first" standpoint. In most cases, both parents love their children and want to spend as much time as possible with them. Both parents also typically believe that it would be in the best interests of the children for that parent to be the custodial parent. These decisions, and the legal process used to resolve them, are complicated and difficult.

Illinois Child Custody issues are often the most difficult and most heavily litigated aspects of a divorce. This decision will impact the life of the child, that of the parents, and the wider family and friend group as much or more than any single component of a dissolving marriage.

While we aggressively litigate custody cases, most child custody issues are settled by tough, lengthy negotiation. Our belief is that when both parents can come together with the aid of exceptional child custody attorneys to make the best decision for the child it is always better than putting the decision in the hands of a third party judge. Sometimes, however, this is not possible, and in that case, having aggressive, knowledgeable representation is essential.

In Illinois, custody may be defined as either legal custody, which determines the right to make important decisions regarding the welfare and upbringing of a child, and physical custody, which refers to what party will have actual physical custody of a child.

In Illinois, the court shall consider all relevant factors without regard to gender including:

(A) the wishes of the child's parent or parents as to his custody;

(B) the wishes of the child as to his custodian;

(C) the interaction and interrelationship of the child with his parent or parents, his siblings and any other person who may significantly affect the child's best interest;

(D) the child's adjustment to his home, school and community;

(E) the mental and physical health of all individuals involved;

(F) the physical violence or threat of physical violence by the child's potential custodian, whether directed against the child or directed against another person;

(G) the occurrence of ongoing or repeated abuse, whether directed against the child or directed against another person; and

(H) the willingness and ability of each parent to facilitate and encourage a close and continuing relationship between the other parent and the child. (750 Illinois Compiled Statutes Chapter 5 Sections: 602, 603 and 610)

Child custody is determined by the best interests of the children. If the two parents cannot agree on the child's best interests, then Illinois courts will require that the parents participate in mediation.
