Another insurance (GEICO) denial for an injury claim from a bicycle accident in Honolulu. The denial is based on Honolulu law prohibiting bicycle use on a sidewalk in a "business district." But, the bicycle rider was in a marked crosswalk on the street, not on the sidewalk. He had the "walk" signal (white lighted pedestrian signal).

UNSAFE/HAZARDOUS CONDITIONS
Business owners, property owners and landlords have a duty to keep their premises in a safe condition. They also have a duty to warn of any unsafe/hazardous conditions on their property. If you are injured because the landlord or business owner failed to live up to their duty, you have a right the right to make a claim. Examples of these kinds of claims include injuries from a broken window or door, etc.

SLIP/TRIP & FALL
These kinds of accidents usually happen when a landowner fails to keep his property in a safe condition. For example, a shopping center that fails to repair cracks in its walkway, or, a supermarket that fails to clean a pool of spilled product. If someone trips or slips in such hazardous conditions, the landlord may be responsible for that person's injuries.

DEFECTIVE PRODUCTS/LIABILITY
Products Liability" claims arise when someone is injured by a defective or dangerous product. Manufacturing or design defect in a product, or, inadequate warnings or instructions regarding the use of a product may also cause injuries for which you can seek compensation. People injured because of dangerous or defective products may not even know that they have a products liability claim. Some victims may think that they caused their own injury. However, if you are injured by a product, it is important that you investigate the product, its history, and/or any other similar claims made because of the product. Manufactures have a duty to make sure that their products are safe, properly labeled, etc.

How did your firm decide on the primary area of practice(s)?

I have always been one to help others thanks to my upbringing as well as my faith. For this reason, I choose to focus on personal injury. I am told by others that I "fight for the underdog" and I truly do. I am here for all clients who are inured and will not "back down" from pursuing your claim, no matter how big, or powerful, the defendant's legal representation. My vision was always to provide the benefits of small firm personal attention, while still having the strength and resources to vigorously pursue your claim. 15 years later and my vision remains as strong as ever.

What is your firm's point of view regarding clients educating themselves on legal issues?

I feel that it is very important for clients to be educating themselves on legal issues. For this reason clients would be able to make better decisions regarding their case and, have some insight when visiting an attorney for the first time.

Is your firm willing to review documents prepared by clients?

I am very willing to review documents that clients have prepared. I would rather documents be prepared correctly from the start rather than trying to correct documents which can lead to additional time consumption and costs.

Is your firm willing to coach clients who want to represent themselves?

I always encourage clients to pursue their own first party workers compensation cases.

What distinguishes your law firm from others?

Here's what our clients are saying:

"I recommend Glenn Honda. I hired Glenn more than 3 years ago. Glenn handled my Car / Auto Accident matter. I have previously worked with 3-5 lawyers. Mr Honda was referred to me as a good lawyer. I have been represented by lawyers in the past 35 years since my husband was killed and I viewed Mr Honda as a good attorney but since the lawyer on the opposing side was aggressive and almost intimidating as I sat by Mr. Honda's side I did not have positive or negative feelings. When it became Mr. Honda's turn to ask questions of the opposite party, his demeanor changed. Initially he did not appear to be listening intensely yet he remembered every point and in a concise, skilled and competent manner he discredited every important factor in the case. He was creative and exuded a winning energy that really amazed and surprised me. He was great and very impressive and I would very highly recommend him to everyone." - Juliette Goodell, a Car Accident client

"I hope my review (my description of Glenn Honda's work as an attorney) will not fall short of how well I was represented by him. He gave me so much support as a client and he (and his staff) worked tirelessly to ensure that the important and salient aspects of our case were up front and center. I never felt unsure of where we stood or what was going on. I always felt that I could contact him at any time to discuss our case and he made himself readily available to me. He is a highly skilled professional with a heart of gold for his clients. He is a tough act to follow! Our case was a very long one and most clients would have given up (maybe some other lawyers would have given up too...I don't know). I didn't give up because he never stopped fighting for me--always in my corner and I felt that he had my back at all times...through the most challenging times. Glenn Honda knows what his clients are going through. His work is impeccable (the man masters his legal skills) and his integrity is refreshing! I have never written a review on anyone... just for the record. But if I could, I would write his name across the sky... that is how much I feel that Glenn Honda is the world's best attorney-ever! If you need an attorney, this is the only one you should retain :o) PS: His staff is awesome also!" - Ceclilia Alvarado, a Car Accident Client

Glenn T. Honda

Prior to founding the Recovery Law Center, I was an associate attorney at the law firm of Jervis & Winer (later becoming Jervis, Winer & Meheula). I later became a partner in the law firm of Jervis, Pico & Honda.

I was injured in a terrible car accident requiring a total of three major surgeries. I can fully understand and empathize with those who have been injured in a car accident through no fault of their own. Insurance companies sometimes make it difficult for you to get the treatment you need. They may create "roadblocks," and, try to force you and your doctor to "jump through hoops."

The Recovery Law Center will deal with the insurance company on your behalf and fight for your rights. I want you to focus on your recovery. I will help you complete the numerous forms which "they" demand and I will prepare you for depositions and other verbal statements.

When you legally qualify to make a personal injury claim, our team will compile all of the records and other documents needed to submit your claim to the insurance company. After a thorough evaluation, I will write a comprehensive demand and settlement letter for your claim and submit it to the defendant or his insurance carrier.

In Hawaii, most injury claims must submit to an initial hearings process called the Court Annexed Arbitration Program (CAAP) before a case can be heard by a jury. At the CAAP hearing, an attorney-arbitrator will hear all of the evidence and make a decision and/or award based on the evidence. Many cases end at this point. However, each side has the right to appeal the CAAP arbitrator's decision. Whoever decides to appeal the decision must do so carefully, because the CAAP rules require the side that appeals to obtain a better award than they did at the CAAP level, or, face penalties. If your case proceeds to trial, our team will spend considerable time preparing you, both from a factual standpoint and for your comfort level. I will work very hard to get you the best results possible, and, will work with other lawyers/law firms if necessary.

I am strong, assertive and aggressive. Intimidation does nothing for me.
