MISSION STATEMENT: To provide professional, courteous, and competent legal services and spiritual counseling to all of our clients recognizing that we are ultimately accountable to God for those to whom He has entrusted us.

The firm was established in 1990, dedicated to assisting people in Eastern North Carolina suffering from financial difficulties, including threats of foreclosure or repossession, burdensome credit card debt, medical bills, tax obligations, and overall overwhelming debt. We have 3 attorneys and a full staff prepared to represent those needing debt relief through Chapter 13, Chapter 7, Chapter 11 or Chapter 12 bankruptcy.

The attorneys in our New Bern, NC location are J. Allen Murphy and Jonathan E. Friesen. They have combined 42 years experience helping people obtain debt relief and a fresh start. The attorney in our Wilmington, NC location is Robert J. Anderson who has 25 years experience.

We represent debtors in the New Bern Division, Greenville Division, and Wilmington Division of the Eastern District of North Carolina Bankruptcy Court. These divisions cover approximately 30 counties in Eastern North Carolina from the South Carolina line to the Virginia line from Goldsboro, NC to the coast.

We also have been helping clients obtain Social Security Disability benefits since 1990. Those who find themselves out of work due to disability deserve benefits and we are available to assist in obtaining those benefits.

The focus of Gillespie & Murphy, P.A. is to help people obtain a fresh start from their financial burden through Chapter 13, Chapter 7, Chapter 11, and Chapter 12 bankruptcy.
Chapter 13 bankruptcy allows our clients to protect their property, house, vehicles, mobile homes, etc. while eliminating unsecured debt such as credit cards, medical bills, personal loans, and other similar debt. Chapter 13 stops foreclosures and threats of repossession and establishes a payment plan to cure any missed payments on the secured property to be protected.

Chapter 7 bankruptcy provides a way to eliminate unsecured debt such as credit cards, medical bills, personal loans, and some federal and state tax obligations while offering exemptions under either federal or state law to protect property such as homes, vehicles, furniture, tools of trade, etc.

Chapter 11 bankruptcy is designed for businesses and corporations to restructure their debt and continue operating.

Chapter 12 bankruptcy is designed to help fishermen and farmers who find themselves in need of financial relief and business restructure to be able to continue to operate and provide for their families.

How did your firm decide on the primary area of practice(s)?

When the firm was established in 1990, the founding partners, Kenneth R. Gillespie and J. Allen Murphy, saw the need in Eastern North Carolina for a firm dedicated to help individuals and families struggling with overwhelming financial burdens. The decision was made to dedicate the practice in the areas of bankruptcy, chapter 13, chapter 7, chapter 11, and chapter 12 to allow people to obtain a fresh start while protecting their property.

What experience or education distinguishes your lawyers from others

The firm's three attorneys and competent legal staff have 25 years of experience helping people in Eastern North Carolina. We have represented individuals, married couples, and small businesses through the bankruptcy process. The attorneys are associated with the North Carolina Bar, Bankruptcy Section and the National Association for Consumer Bankruptcy Attorneys to maintain their credentials and keep up with changes in the law.

What distinguishes your law firm from others?

We have a genuine concern for our clients and strive to guide them through what we know can be a stressful situation. Each case is handled by one attorney and one case manager throughout the entire process so the client will know who to contact and have ready accessibility for any need that may arise. Allen Murphy

Allen Murphy has lived in Eastern North Carolina all his life. He was born in Kinston, North Carolina where he completed high school. He settled in New Bern after graduating from Law School in 1985 He lives with his wife to whom he has been married since 1979. He has two children. The oldest is Lindsay, born 8/13/87. The youngest is Jordan, born 3/19/90.

He has been practicing law since 1985. He is a partner in the law firm Gillespie & Murphy, P.A. which formed in September 1991. The focus of his practice is bankruptcy (Chapter 13 & Chapter 7 Debt Relief). Allen graduated with honors from Mount Olive Jr. College and continued his education at East Carolina University where he graduated with honors in political science. He was on the Dean's List at both Mount Olive Jr. College and East Carolina University. He obtained his legal education at North Carolina Central University in Durham, North Carolina, receiving his J.D. Degree in 1985 graduating Magna cum laude. He was on the North Carolina Central Law Review.

Allen is a member of the North Carolina State Bar being admitted to practice in 1985. He is a member of the North Carolina Bar Association, National Lawyer's Association and the Christian Legal Society, National Association of Consumer Bankruptcy Attorneys. He is licensed to practice in all courts in the state of North Carolina, U.S. District Court and Bankruptcy Court for the Eastern District of North Carolina, 4th Circuit Court of Appeals and the U.S. Supreme Court.

Allen, Jane, Lindsay and Jordan currently worship our Lord at Temple Baptist Church in New Bern, North Carolina. Allen is active in the Temple Drama Ministry Team and teaches a Bible Fellowship Group as well as other ministries within the church. He is active in the ministries of Focus On The Family, Family Research Counsel, Promise Keepers, as well as other Christian organizations.

Allen believes that you can be an effective lawyer while being an effective Christian.

Jonathan Friesen

Mr. Friesen's practice concentrates on commercial and residential real estate, business and corporate law, and Chapter 7, 11, 12 and 13 bankruptcy, workouts and alternatives to bankruptcy and social security disability. Mr. Friesen earned his B.A. and J.D. from the University of Nebraska at Lincoln. Prior to attending law school, Mr. Friesen managed farms for the agri-business corporation Murphy Family Farms, headquartered in Rose Hill, North Carolina, then the world's largest swine producer. Mr. Friesen was admitted to the North Carolina State Bar in 2003, and the Nebraska State Bar in 2005. Mr. Friesen is a Super Lawyers Rising Star for 2013.

Robert Anderson

Bob was born and raised in Southern California. He attended the University of Redlands, graduating cum laude in 1978 with a Bachelor's Degree in English. He attended Loyola Law School's Evening Division while working full time as a Correctional Officer in the Maximum Security SHU unit at the California Institution for Men at Chino. He graduated with his Juris Doctorate from Loyola in 1985 and was admitted to practice in California in December, 1985.

In the Fall of 1982, Bob accepted the Lord Jesus Christ as his Savior, a decision that completely changed the course of his life. Law school was no longer about preparation for a prestigious career; it was about preparation for a ministry of helping people who are financially broken.

Bob was an associate in a mid-sized Christian law firm in downtown Los Angeles for the first 10 years of his practice and later opened his own practice to be closer to home. From the beginning of his practice he has worked exclusively in the area of Debtor/Creditor law, representing debtors, creditors, Chapter 7 Trustees, Receivers and Assignees for the Benefit of Creditors.

Bob met his wife, Susan, at a church Bible Study. They were married in 1984 and have 4 Children, one of which went to be with the Lord following a miscarriage. His family relocated with him to North Carolina in 2006. Bob started with Gillespie & Murphy in 2007, working as the Office Manager for the Wilmington Office while he studied for the North Carolina Bar Exam. Bob was admitted to practice in North Carolina in August of 2008 and now exclusively represents debtors in consumer and small business Chapter 7 and 13 cases out of the Firm's Wilmington Office.
