Litigation
Successfully handling commercial disputes requires a great deal of creative thinking.
Almost always, the parties have had a relationship that pre-existed the litigation. Often the parties have a continuing business relationship. In every case, the client has practical concerns about how the litigation will affect its business.

At Fox Galvin, we use our skills to seek "win-win" results in commercial litigation. Because of our courtroom experience, we are able to negotiate from a position of strength, and can often use mediation to successfully resolve a case with minimal intrusion into the client's business operations. We have experience with breach of contract cases, warranty claims, covenants not to compete, distributor claims, allegations of fraud, billing irregularities, collection cases, and a variety of other disputes.

We have substantial expertise and experience in the analysis and litigation of insurance coverage issues arising under commercial general liability, marine, automobile, homeowners, and professional liability policies at the primary, excess, and umbrella levels. Our skills allow us to research and analyze many different types of insurance coverage issues and to effectively communicate coverage positions to clients, courts, and opposing counsel. Maritime
Fox Galvin has represented numerous marine companies, including towing companies, barge owners, dry dock and loading dock operators, casino boats, stevedore operations, underwriters, brokers, and fleeting and harbor services.
Marine lawyers at Fox Galvin have over 40 years of experience successfully defending marine interests in many jurisdictions, including state and federal courts.

Fox Galvin attorneys are frequently called to board vessels or go to an accident site, often in the middle of the night, to promptly investigate events and gather information. All of our marine lawyers have TWIC cards. We have tried many Jones Act cases, limitation of liability actions, 905(b)/longshore cases, Maritime insurance disputes, and Coast Guard licensure actions.

Fox Galvin currently represents major barge lines in defense of their Jones Act and other personal injury litigation in Missouri, Illinois, Indiana, Ohio, Kentucky, and elsewhere throughout the central United States. We have defended and prosecuted various multi-million dollar property damage cases resulting from navigational issues, cargo shipments/handling, and flooding.

Although marine trial defense work is a major component of our practice at Fox Galvin, the multi-disciplinary trial work of our attorneys affords us a breadth of experience and contacts not normally found with lawyers who practice only maritime law. For example, our defense of the health care industry allows us to become acquainted with many physicians and health care providers who practice in the very medical areas where our Jones Act injury cases are focused. Further, in our defense of a multi-million dollar claim against a major casino interest, our knowledge of product liability law enables us to locate and select experts based on prior experience in defending product liability actions.

Michael Donelson practices civil litigation with an emphasis on professional liability, personal injury and product liability defense. Prior to completing law school, Mike worked for eleven years as a liability analyst in the insurance industry, the last six years of which were with a major physician's professional liability carrier.

As a practicing lawyer, Mike's focus has been civil litigation and trial practice. He has extensive experience in investigating and developing case strategy for complex litigation cases including the identification and retention of appropriate expert witnesses, deposing key witnesses and experts and developing trial strategy. Mike has extensive trial experience as he has had primary responsibility for both jury and bench trials in the state and federal courts of Missouri and Illinois.

Representative Cases:

-In Property Management Co. v. General Contractor, Mike represented an architectural firm in a multi-party lawsuit brought by a property owner who alleged building and design defects in a large apartment complex with damages in excess of $800,000. During the course of the litigation Mike used his knowledge and understanding of his client's role in the case to elicit helpful testimony from several witnesses which allowed him to negotiate a favorable settlement on his client's behalf saving his client significant defense costs and liability exposure at trial.
-In Patient v. Urologist, Mike assisted in the defense of a urologist who was sued for an alleged negligently performed vasectomy. Mike's examination of the subsequent treating physician provided key testimony at trial which led to a verdict in favor of his client after a five day trial.
In Patient v. Surgeon, Mike assisted in the defense of two general surgeons who were accused of negligently managing the post-operative care of a woman who developed post-operative bleeding and died. Mike diligently investigated the case and retained appropriate expert witnesses which allowed for the case to be successfully defended through trial.
-In Patron v Casino, Mike represented a construction company in claim brought by a casino patron who claimed that she had fallen on uneven pavement and ultimately required a total knee replacement. Through diligent investigation and thorough examination of witnesses in the case, Mike was able to get his client dismissed from the lawsuit without payment of any settlement.
-In Steelworker v. General Contractor, Mike represented the general contractor sued by a steelworker who claimed a job related back injury requiring multiple surgeries. Mike's through investigation and deposition skills provided the basis by which his client was to obtain a dismissal of the case with only a nominal payment.
-In Insured v. Insurance Company, Mike represented a pedestrian struck and seriously injured by an underinsured driver. Through his knowledge of the insurance industry, Mike was able to identify additional amounts of insurance coverage and convince the insurance company of its liability in order to secure his client fair compensation.

Katherine M. Fowler is a partner at Fox Galvin, specializing in the defense of complex litigation, including pharmaceutical litigation, medical malpractice, product liability defense, personal injury litigation, environmental litigation, commercial litigation and class action litigation. She has significant experience defending hospitals, nurses and physicians in personal injury and wrongful death claims. Her superior analytical and communication skills allow her to consistently obtain successful and cost-effective results for her clients.

Prior to joining Fox Galvin, Katie worked as an associate in the litigation department of a large regional law firm. She also served as the City attorney for the City of Kirkwood Board of Adjustment and City of Crestwood Board of Adjustment.

Since joining Fox Galvin, Katie has:

-Obtained 100% recovery in a commercial lease dispute. After Katie won a verdict for her client at trial, the defendant fraudulently transferred assets to avoid collection. Katie relentlessly pursued collection and devised a novel strategy, successfully obtaining a creditor's bill in equity to allow collection of the fraudulently transferred assets. In addition to collecting the full judgment which was in excess of $100,000, Katie recovered costs and post-judgment interest.
-Obtained a directed verdict in a medical malpractice action on behalf of a nationally known hospital.
Assists in the defense of Bayer Corporation (including related domestic and foreign entities) in the Magnevist litigation, Trasylol litigation and In re Genetically Modified Rice litigation.
-Obtained dismissal of an action alleging violation of the Americans With Disabilities Act against a nationally known hospital based on plaintiff's failure to obtain an affidavit supporting her claims in compliance with RSMo 538.225. This decision was upheld on appeal and has served as precedent in several subsequent cases interpreting RSMo 538.225.
-Negotiated a favorable settlement of a shareholder's lawsuit alleging wrongful conversion of stock during the cash and share elections conducted in connection with a corporate merger.
Second-chaired a medical malpractice case to a defense verdict in the City of St. Louis.

John Galvin has obtained newsworthy results for major US and international clients in litigation at the local, regional, and national levels. He has taken cases to verdict in some of the most challenging state and federal courts, winning over 90% of the cases he has tried. These include cases involving catastrophic injury alleging defects in a variety of products, from automobiles to construction equipment to farm implements, as well as various business litigation claims. When the judges of the Circuit Court for the City of St. Louis needed a lawyer to represent them in a dispute with a state agency, they hired John. He successfully argued the case before the Missouri Supreme Court, bringing home a victory for the Circuit Court judges.

John's trial experience has led to him being asked to serve as a member of national trial teams in major pieces of litigation, including:

In the GM Rice litigation, John was National Settlement Counsel with the job of resolving over 8,000 claims alleging economic losses due to a decline in the price of rice, and alleged damages in the billions of dollars. -Defeat of class action seeking recovery for impact to DNA following a gasoline spill

Environmental Litigation:
John's involvement in environmental litigation includes cases involving oil refineries, underground storage tanks, nuclear fuels facilities, and gasoline pipelines. He has litigated matters involving both air and water claims, under a variety of federal and state statutes, as well as common law personal injury and property damage claims. He has been retained, for example, by an oil company to defend government and neighborhood claims brought relating to a 1988 release of over 100,000 gallons of gasoline from a pipeline.

Community Service:
John and his wife Suzanne are also the founders of New Commandment Ministries, a Christian charitable organization helping children at risk, with projects for education, medical and vocational training both here and abroad. John has participated in five mission trips to Nairobi, Kenya, where NCM has started medical clinics, built school classrooms and kitchens, and initiated sewing and computer labs. Additionally, John works as a Chaplain, certified in disaster response counseling, with the Billy Graham Evangelistic Association, and has been deployed to earthquakes, hurricanes, floods, and shootings to provide emotional and spiritual care for victims of crises.

Suzanne Galvin has over fifteen years experience handling product liability, medical malpractice, class action, and commercial litigation. She has defended a variety of clients, including:

Suzanne has obtained several notable outcomes in high profile cases. Her successful outcomes include:

-A man in his 20s was severely burned from the waist down when the gas cap came off his motorcycle. Suzanne represented the motorcycle manufacturer in defending the case in the City of St. Louis. Suzanne was able to develop enough evidence to prove the gas cap on the motorcycle at the time of the accident was not the original cap; thus, the case against her client was dismissed on summary judgment.
-Suzanne assisted in representing a doctor who was alleged to have failed to diagnose a heart condition. The plaintiff, in his early 60s, died of a heart attack just six days after seeing his doctor. The case was tried in the City of St. Louis, and the jury returned a defense verdict.
-When a factory caught fire and amassed over $24 million in damages, Suzanne represented the local fire protection company who designed, installed, and maintained the fire protection system. This litigation potentially threatened the future of this local company. After investigating the case, deposing the principals of the companies, and hiring cause and origin experts, Suzanne was able to develop an alternate theory to the cause and origin of the fire. Ultimately, the client paid less than 1% of the original loss. The local company was so pleased with the service provided by Suzanne, they retained Suzanne to recommend the adoption of Risk Management policies and procedures.
-After a trial court issued a "drive by" certification creating a nationwide class of vehicle owners, Suzanne drafted briefs asking the Court to vacate its ruling, arguing the ex parte certification violated the automobile manufacturer's due process rights. The Court granted the Motion, effectively turning a class action case with over $1 billion at issue into an individual claim worth less than $10,000. The case then settled for nuisance value.

Suzanne was formerly Risk Manager of Barnes-Jewish Hospital in St. Louis, one of the largest and most respected facilities in the nation. Her contacts with doctors and nurses benefit Fox Galvin clients. In addition, Suzanne has served as a board member for numerous civic and charitable organizations, including Legal Advocates for Abused Women ("LAAW"), a not-for-profit organization dedicated to helping women and children who are victims of domestic violence. Suzanne has appeared in literally hundreds of hearings in five different Missouri counties; she has never had an Order of Protection denied for a client. She has also taken part in Christian relief efforts, including trips to India, Kenya and Haiti, and has deployed to multiple sites in the U.S. as a disaster relief chaplain.

Meggie Gentzen, a Saint Louis University School of Law graduate, joined the Fox Galvin team in 2012. Prior to Law School, Meggie served as the Government Affairs Director for a local non-profit trade association, where she lobbied on behalf of member interests. While in law school Meggie worked for the St. Louis County and Eastern District of Missouri Prosecutor's offices, a local defense firm, and as a legal clerk for a U. S. Magistrate Judge in the Eastern District of Missouri. Since joining Fox Galvin, Meggie has acquired knowledge in the pre-trial process by assisting in the defense of local hospitals as well as pharmaceutical and environmental companies.

Richard, a native of St. Louis, began his legal career in Chicago, Illinois- practicing at two well-known defense firms. -After a 7 day medical malpractice trial in Williamson County, Illinois, a defense verdict in favor of his physician client in a case where the plaintiff alleged medical negligence arising out of the performance of a vasectomy.
-In a rear-end trucking accident case filed in the United States District Court for the Southern District of Illinois, after admitting liability, a jury verdict in the amount of $113,000 in a case involving four plaintiffs where the plaintiff's counsel asked the jury for an award of over $1,200,000.
-Numerous summary judgments and dismissals of claims against lawyers for legal malpractice, as well as dismissal of a $5 million legal malpractice and RICO claim brought against his client, affirmed on appeal by the Seventh Circuit Court of Appeals.
-Dismissals and summary judgments in state and federal courts on various employment discrimination claims arising under Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and their state law counterparts.
-After a bench trial in the United States District Court for the Eastern District of Michigan, a $3.5 million judgment in favor of his client in an insurance coverage dispute arising out of an underlying wrongful death action.

Ryan Mohr concentrates his practice in commercial and environmental law involving a variety of litigation and regulatory compliance issues. Erika N. Reynolds handles all aspects of pre-trial litigation in her practice areas. Erika's mass tort litigation experience includes representing a multi-billion dollar international company in genetically modified rice MDL and a high-exposure women's birth control MDL. Earlier this year, Erika assisted a team that obtained partial summary judgment and defeated an attempt to certify a class of personal injury claims against a multi-national oil company in Illinois.
