What are the two things that make semi collisions completely different legally than auto crashes?

The answers may surprise you.

First, there are multiple potential defendants to sue, and secondly semis are subject to different laws- state and federal regs that don't apply to auto collisions.

There are several people and/or companies that may be held liable in a trucking accident. Was the truck driver an employee or an independent contractor? Was the truck owned by the driver or by a company? Was the truck properly maintained? Was the cargo in the truck properly loaded? Was the accident due to negligence or recklessness on the part of the driver?

There are several causes.

Driver error: common driver errors include speeding, following cars too closely, dangerous lane changes, failure to obey traffic signs, failure to adapt to adverse weather or road conditions, failure to stay in a lane, fatigued driving, distracted driving, or driving under the influence of alcohol or drugs.

Improper cargo loading:

Possible liable parties often include the driver, truck owner, truck manufacturer, manufacturer of specific defective parts on the truck, 3rd party companies that perform truck maintenance, the owner or loader of the cargo, or the company who leases the truck or employs the driver.
Vehicles subject to interstate trucking laws must meet regulations which include driving time, truck maintenance and load safety.

As one example of something that may surprise you - a semi and a local landscaping truck can both be covered by the same federal regulations.

All relevant evidence must be preserved immediately. Although preserving evidence is important in all cases, there are special hoops to jump through here that only an experienced attorney knots how to do. If this is not done crucial evidence can "disappear. For example, the logs drivers are required to keep that could prove they were fatigued can be gone.

Because of the high risk of loss on these claims, most semi companies have local investigators who go to the scene immediately to begin building their case against you. They try to contact injured parties before they have an opportunity to seek counsel, find out their rights and ensure that evidence is preserved.

If you were rear ended you might assume the semi company will automatically accept fault. That is not true, their claims adjust will try to get you to say something when they take your statement allowing them to claim one of the following:

-You pulled in front of them
-You stopped too suddenly
-Weather conditions made it impossible for them to stop

As you can see, deciding who to bring a claim against a semi company or large trucking company can require extensive investigation and complicated questions.

No one goes out expecting to be in a collision. A collision is a very stressful and emotional event. Because of the stress, you may not be thinking clearly at the scene and it is very important that you know how to protect yourself and your legal rights.

Before I was an attorney I was in a bad crash. Let me tell you, the only thing I wanted to do was go tell the person that wrecked my car what I thought about their bad driving.

Fortunately, I couldn't get the car door to open. Then I remember someone came up to the window and said they had seen everything that happened, had called the police and I needed to wait for an ambulance> I said I was fine and started insisting I needed to get out of the car and they said, no, don't you know your head is bleeding all over the car?

Now that I'm a personal injury attorney I wanted to make this video to help others regarding what they should do in a collision in Indiana:

The first concern is whether you or anyone in your vehicle is injured.

1.Call 991. This is very important because it ensures you will receive appropriate medical attention, and so that the police make a report.

2. If you are physically able to do so, take photographs of the scene and of the vehicles involved.

3.Because your emotions are heightened, it is critical not to make any admissions of fault or discuss fault with anyone at the scene, especially the other driver. Statements you make could jeopardize your claim. Medical treatment should be your focus. The assessment of fault is a legal determination anyway and difficult for lay people to make.

4.Do obtain any witnesses names, addresses and phone numbers and make notes of what they say happened. Sometimes witnesses leave before the police arrive or the information is not on the police report.

5.Do not leave the scene. Wait for the paramedics and police.

6.If you haven't been transported to a hospital by the time the police officer arrives, obtain the officer's name and phone number. Tell the officer what happened.

7.Seek medical treatment immediately. If you aren't transported by ambulance, you should have someone take you to an emergency room or an immediate care facility right away.

8.Take photographs of your injuries.

10.Do not call the other person's insurer before talking to an attorney. Their insurance company is not on your side. Their goal is to make money for the company that insures the person who injured you. The first thing they will want to do is take your statement. Any statements you make to the other person's insurance company can jeopardize your claim.

11.Do call your own insurance company and let them know what happened.
