How did your firm decide on the primary area of practice(s)?

Ohio's iconic personal injury law firm, Elk & Elk, is a family business with its roots in rural Ohio. The vision of two brothers, David and Arthur Elk, started back in 1984. Art, as a two-term Prosecuting Attorney of Ashland County, recognized the need to bring a specialty practice of injury law to rural Ohio. He recalls, "Rural Ohioans were being taken advantage of by big insurance companies and the big wall street corporations who were more interested in profit than people."

Today, our team is comprised of more than 100 professionals, including 18 attorneys and a dynamic support staff comprised of dedicated paralegals, nurses, investigators, accountants, accident reconstructionists and other injury experts.

Arthur Elk

Arthur is the Managing Member of Elk & Elk in Cleveland, Ohio. As an Ohio personal injury lawyer and medical malpractice lawyer, he has represented medical malpractice and wrongful death victims for almost five decades. Art, just two years out of law school, was elected Ashland Ohio's County Prosecuting Attorney for two successive four-year terms. After having been the youngest prosecuting attorney in the state of Ohio, Art chose to leave the public sector and enter the private practice of law. Art has found great satisfaction in providing injury victims with quality legal services in all major areas of injury law.

When Art is not representing the rights of injury victims, he enjoys spending time with his wife and four children.

David Elk

David is the Senior Partner of Elk & Elk in Cleveland, Ohio. As an Ohio personal injury lawyer, he has represented thousands of medical malpractice and wrongful death victims throughout the state for nearly 50 years. Dave believes that quality legal representation allows all people to level the playing field against the big insurance companies. He has devoted his entire professional life of almost five decades to helping injured people receive the compensation they deserve.

Dave began his professional career with one of the largest and most prestigious personal injury law firms in Ohio and spent his first seven years under the wing of Ohio's best. After practicing on his own for several years, his entrepreneurial spirit got the better of him and he ventured into a practice with his brother Art, whom together built geographically one of the largest injury practices in the state of Ohio.

When Dave isn't representing the rights of injury victims, he spends his time being an active husband, father and grandfather to his wife Marilyn, three children, granddaughters Meredith, Madison and Celia, and grandson Dylan. Dave is also a lifelong Cleveland Indians fan, and frequently attends games with family and friends.

James Kelley

Jay, a partner at Elk & Elk since 2011, focuses on civil trial work in state and federal courts in matters of medical negligence and wrongful death arising from birth injury, surgery; oncological, cardiac and pharmaceutical product liability causes. Jay has presented more than 70 cases to jury, including: felony prosecution, criminal defense, civil defense and civil plaintiff cases. He has been lead counsel on cases in more than 30 Ohio counties, appellate courts and the Supreme Court of Ohio.

Jay was included in the 22nd and 23rd Edition of The Best Lawyers in America for Medical Malpractice Law and Personal Injury Litigation.

John O'Neil

John P. O'Neil joined Elk & Elk Co., Ltd. in 2012 as an equity partner. He is one of the firm's leading medical malpractice and personal injury attorneys, whose practice focuses primarily upon death and catastrophic loss cases. Prior to joining Elk & Elk, John spent 14 years at one of Ohio's top defense law firms, where he served as a practice area chair and member of the firm's management committee and executive group. He also spent time working as a successful prosecutor in the Dade County State Attorney's Office. Over the years, John has successfully tried more than 80 jury trials in various areas of law, including medical malpractice, transportation, legal malpractice, premises liability and others. John's first chair jury trials are in state and federal courts, and he has argued in the Eighth District Court of Appeals, Ohio Supreme Court and Sixth Circuit Court of Appeals.

John practices with the Ohio firm of Elk & Elk Co., Ltd., located in Mayfield Heights. He received his undergraduate degree from Miami University in Oxford, Ohio and his law degree from John Marshall Law School in Chicago, Illinois.

Phillip Kuri

Phil, a partner at Elk & Elk since 2012, focuses on injuries of a catastrophic nature including personal injury, medical malpractice, trucking, products liability and general tort law. He has won substantial verdicts and settlements on behalf of his clients.

In addition to his legal practice, Mr. Kuri maintains active memberships in the American Bar Association, and the Ohio State Bar Association. Marilena DiSilvio

Marilena DiSilvio joined Elk & Elk Co., Ltd., as a partner, in 2014. A former registered nurse and experienced trial attorney, Marilena's practice focuses on birth injuries, medical negligence and personal injury. Prior to joining Elk & Elk, Marilena spent 17 years with a leading Cleveland defense firm, where she was a member of the firm's Executive and Management committees and served as chair of the Health Care Law Practice group. Marilena has tried more than 50 medical malpractice cases. Her extensive experience serving the defense bar has provided her with invaluable knowledge regarding medical malpractice and health care law.

Marilena has been recognized as an "Ohio Super Lawyer" every year since 2009, listed in Best Lawyers in America, and elected to the American Board of Trial Advocates.
