The Key to Winning Your Family Law or Personal Injury Case

No one marries or has children hoping to one day divorce or fight over custody, just as no one gets behind the wheel hoping to be in an accident. When these things happen, to protect your rights, your family and your future, you must know the key to winning the best possible outcome for your case.

Most divorce, custody and personal injury cases eventually settle by agreement between the parties. This provides certainty to the parties and is usually less stressful than trying the case. However, the key to getting a fair settlement in the shortest amount of time possible is the willingness to go to court if necessary.

When you are facing an Austin, Texas family law or personal injury case, you need leverage to resolve the case in your favor and protect your interests and your family. The only leverage you have comes from being prepared to go to court if necessary. This means letting the other side know that, if you do not settle, you are ready to go to court and get an even better result. The only way to do this is by hiring a trial lawyer.

The Todd Law Firm Difference

There are many lawyers to choose from for your Austin, Texas divorce or accident case. However, all Texas family law and personal injury lawyers are not the same. Many attorneys never take cases to trial and therefore lack the skill and confidence to go to court and win. Ironically, using this type of attorney can make it less likely that your case will settle, or at least settle for something that makes you happy.

Hiring a "settle at all costs" lawyer means your case may take longer, cost more and yield a worse result than if you hired a trial lawyer to prepare your case for court from day one. On the other hand, hiring a trial lawyer allows you to bargain from a position of strength instead of fear. Being ready for trial usually leads to faster and more favorable settlements. And, if you have to try the case, you have the confidence that comes from being prepared.

David Todd began his legal career trying many criminal jury trials. This experience taught him how to present a compelling case to a judge and jury under the difficult circumstance of defending someone accused of a crime. Since changing his focus to representing Texans in divorce and personal injury cases, his trial experience and willingness to take cases to court have been key to obtaining excellent results for hundreds of clients. David Todd is board certified in family law by the Texas Board of Legal Specialization.

David Todd

My name is David Todd and I've been representing Texans in personal injury law and family law matters since 1989. I was born in Dallas, where I was active in the Boy Scouts of America, earning my Eagle Scout rank. I graduated from St. Mark's school of Texas in 1982. I attended the University of Texas at Austin for my undergraduate studies, and I earned a BA degree in Honors Liberal Arts (the "Plan II" program) with highest honors, Summa Cum Laude, Phi Beta Kappa, in 1986. I received my JD from the University of Texas School of Law in 1989, where I served on The Review of Litigation. I founded my law firm in 1989 and I have practiced law in Austin, Texas ever since.

I am a member of the College of the State Bar of Texas, and I am a member of the Texas Trial Lawyers Association and the Capital Area Trial Lawyers Association, as well as the Family Law Section of the Austin Bar Association. I am board certified in family law by the Texas Board of Legal Specialization.

My focus is representing individuals injured by the negligence of others, as well as those facing divorce and other family law issues, such as child custody, child support, asset division, and modification or enforcement of existing family court orders. Each case receives personal, attorney attention (not just paralegal work) and we take pride in making sure the client stays informed about and involved with their case every step of the way. By focusing on the few cases that meet our standards for acceptance, we are able to devote the time and effort needed to obtain the best possible results.

After years of litigating divorce and injury cases, I wrote a number of legal guides (available for free download on our website davidtoddlaw.com) to help Texans learn how to avoid common mistakes and protect their rights so they can resolve their case and get on with their lives.

As part of our commitment to helping injured children, we donate a portion of our fee from each child injury case to the Dell Children's Medical Center. We are also a proud supporter of the Austin Center for Child Protection.
