For me, criminal law is the only area of the law. Growing up, watching Perry Mason and other legal shows and movies, it was always a criminal lawyer, not a probate lawyer or tax lawyer who helped the person facing the full weight of the government in a prosecution.
I appreciate clients who self-educate about the law. However, a little knowledge can be a dangerous thing. Clients need to understand the complexities and nuances of the law and the personalities of the prosecutors, judges, probation officers, law enforcement officers, etc.
However, clients who understand what the law is in their particular case can be better clients because they know what the court expects and how the facts of their case will be viewed.
I will review pleadings prepared by a client, but if I am their attorney, they must understand the court most likely will not accept filing of those documents. Pleadings must come from the attorney. If the client's documents present valid points of law and argument I will then incorporate that content into a pleading which I can then file with the court.
If people want to represent themselves in court - that is their constitutional right. However, it may not be in their best interests to represent themselves. Remember the old adage: A man who represents himself has a fool for a client.
I began my legal career in Kansas City, Missouri, as a solo attorney providing legal representation to individuals charged with violating criminal laws from misdemeanors to felonies - in state and federal courts. From 1989 to 2007, I was an Assistant Federal Public Defender, rising to the position of First Assistant. During my 18 years at the Federal Public Defender's office, I defended individuals charged with all types of crimes, including high profile cases of white collar crime, drugs, computer crimes, weapons offenses, conspiracy and death penalty defense.
I have lived in various countries, cultures, economic conditions and political philosophies. Having been the underdog I am better prepared to fight for the underdog.
