WHAT IS ERISA?

Although there are exceptions, most disability, life, health and long-term care policies, as well as pension benefits, provided by your employer are covered by the Employee Retirement Income Security Act (ERISA). This federal statute usually pre-empts state laws designed to protect consumers and creates significant (but not insurmountable) hurdles for claimants seeking benefits to which they were promised. Our lawyers know how to interpret these ERISA statutes, the applicable Department of Labor Regulations, the plan documents and the case law of the federal courts to protect your entitlement to benefits.

NON-ERISA CLAIMS

If you purchased a long-term disability, short-term disability, life insurance, long-term care insurance policy or you work for the government or a church-related organization, then ERISA does not usually apply and the state laws designed to protect insured individuals are available for our attorneys to use in securing your benefits. Regardless of the specific type of policy you have, we will work to secure your benefits.

J. Scott Kilpatrick

Mr. Kilpatrick's focus is on civil litigation, emphasizing insurance disputes, serious injuries and wrongful death. These cases include losses caused by construction or other work related accidents, defective products, motor vehicle accidents and criminal conduct. Mr. Kilpatrick also handles business and insurance disputes, including ERISA and non-ERISA life and disability claims. Mr. Kilpatrick is a former criminal prosecutor, who subsequently worked for five years as an insurance litigator, and who now devotes his practice to representing people - victims who require the firm's skill, experience and determination in order to enforce their rights and secure just compensation.

Mr. Kilpatrick is a member of the Rhode Island and Massachusetts Bar Associations and sits on the Rhode Island Federal Bench/Bar Committee. He is also a member of the Federal Bar Association, where he served as the President of the Rhode Island Chapter. He is a member of the American Association for Justice and the Rhode Island Association for Justice, where he serves on the Board of Governors. Mr. Kilpatrick is also a member of the National Employment Lawyers Association, and has been a featured speaker for the National Business Institute and the Rhode Island Bar Association on issues such as Trial Evidence in Federal and State Courts, Trial Practice and ERISA Insurance Litigation. He is also a contributing author to the last three editions of the American Bar Association's book ERISA Survey of Federal Circuits. He also serves on the Civil Pro Bono Panel for the United States District Court for the District of Rhode Island.

Mr. Kilpatrick has been a trial attorney since 1988. He has tried more than 35 trials to a jury, and many more before judges, arbitrators and mediators. He focuses his practice on representing people, and families of people, seriously injured or killed by construction accidents, defective products, negligence of others, criminal acts, premises liability, and auto accidents, as well as those improperly denied insurance coverage or benefits. He also handles and litigates business disputes.

Mason J. Waring

Mason has an active civil litigation practice in the federal and state courts, focused on representing individuals in the application, appeals and litigation of life, health, short-term disability and long-term disability insurance benefits under the Employee Retirement Income Security Act (ERISA) and under private insurance contracts. Mason's practice also includes litigation of personal injury, business, employment and contract disputes. Nationally, Mason represents claimants in ERISA and non-ERISA administrative appeals of denied benefits.

Mason has been recognized by his peers as a Rising Star by "Super Lawyers" since 2013, and is a contributing author to the American Bar Association's book, ERISA Survey of Federal Circuits. Mason serves as the Chair of the Young Lawyers Committee for the Federal Bar Association, Rhode Island Chapter. He is also a member of the Rhode Island Bar Association and Rhode Island Association for Justice.

Robert V. Chisholm

Mr. Chisholm's primary focus is on representing disabled veterans in the United States Court of Appeals for Veterans Claims and before the Department of Veterans Affairs. Since 1990, Mr. Chisholm has been representing veterans before the United States Court of Appeals for Veterans Claims (CAVC) and the Department of Veterans Affairs (DVA). In that time, he has successfully represented hundreds of veterans in Court and before the Department of Veterans Affairs. In addition, Mr. Chisholm has represented veterans before the United States Court of Appeals for the Federal Circuit. Mr. Chisholm has also written numerous briefs as friend of the court in support of other veterans' cases.

In 1999, Mr. Chisholm was elected to serve as the President of the National Organization of Veterans Advocates (NOVA). NOVA serves attorneys and non-attorney practitioners admitted to practice before the CAVC. Mr. Chisholm is a frequent featured speaker at national conferences and meetings regarding veterans' rights. Mr. Chisholm was also elected to serve as the President of the CAVC Bar Association in 2002.

Mr. Chisholm has also testified before the Senate Veterans Affairs Committee and the House Veterans Affairs Committee on legislation affecting veterans.

Leah Small

Leah received her J.D., cum laude, from Boston University School of Law in 2016 after earning her B.A. in Political Science, summa cum laude, from the University of Rhode Island in 2013. During law school, she served as a staff member on the Boston University Law Review, and gained practical experience as a legal intern at Chisholm Chisholm & Kilpatrick and the Rhode Island Office of the Attorney General. She also worked as a judicial extern in the chambers of the Honorable O. Rogeriee Thompson of the United States Court of Appeals for the First Circuit

Stephanie F. Friedel

Stephanie's practice focuses on representing individuals in the application, appeal, and litigation of life, health, short-term disability and long-term disability insurance benefits under the Employee Retirement Income Security Act (ERISA) and under private insurance contracts. Stephanie's practice also includes litigation of personal injury, business, and contract disputes in both state and federal court.

Stephanie received her J.D. from Boston University School of Law in 2015 after earning her B.S. in Political Science, summa cum laude, from Northeastern University in 2011. During law school, she served as the Executive Editor of Boston University's Public Interest Law Journal. Stephanie was also a member of Boston University's Employment Rights Civil Litigation Clinic, where she represented indigent clients at administrative hearings before the Department of Unemployment Assistance and in District Court. She also served as a judicial extern at the United States Court of Appeals, for the First Circuit. In the summer of 2014, she was awarded the Loretta Smith Honors Internship at the Massachusetts Attorney General's Office.
