The owner and lead attorney of California Traffic Defenders, Robert M. Amparan, has nearly two decades of litigation experience, including working for the San Francisco Public Defenders Office, where he garnered extensive experience working with these same issues within the local court and justice system. At California Traffic Defenders, a major portion of our practice is focused specifically upon assisting California drivers who are facing charges for traffic offenses, whether infractions, misdemeanors, or felonies.
Just about everyone has experienced that dreadful, sinking feeling of seeing red flashing lights behind them as they drive down the street or highway. Sometimes you know exactly what you will be cited for: failing to come to a complete stop, speeding, running a red light, or making an illegal lane change. At other times you are mystified: Did I miss a stop sign? Is one of my tail-lights out? Maybe you had a drink or two and are worrying whether you were driving erratically without even knowing it.

No matter what the answer is, you know it is going to cost you. Even the lowest California fines for traffic infractions when combined with fees and surcharges are over $100, and can run much higher, depending upon the offense and whether there are enhancement factors, such as committing a violation within a highway construction zone. And, if you are commercial driver, even minor violations can easily cost over $1,000, and, depending upon how serious it is, could jeopardize your ability to earn a living. Even more, many offenses put points on your driving record that can cause your insurance rates to skyrocket.

At California Traffic Defenders, we understand the gravity of traffic offenses and the impact these penalties can have on your life. We also know that, for most Californians, the driving privilege is all but essential: to go shopping, to get to work, and to drop off and pick up children at school or the doctor's office. For some, a valid drivers license and a clean driving record is a prerequisite for employment.

California Vehicle Code Section 23152 makes it illegal for anyone under the influence of alcohol or drugs to drive a vehicle if their level of intoxication impairs their ability to operate a vehicle safely, or if their Blood Alcohol Content (BAC) is over the legal limit. Consistent with nationwide standards, in California, the legal limit is 0.08% BAC. For most people of average weight, this limit can be exceeded with just two drinks consumed within one hour.

For commercial drivers, the BAC limit is 0.04%. For individuals under 21, the BAC limit is 0.01% in other words, zero tolerance. DUI laws also apply to other types of intoxication, such as being under the influence of any illegal drug, or under the influence of any medication whether prescription or over-the-counter that can impair ones driving ability.

Further, California has an implied consent law: if you drive in California, you consent to a chemical test when lawfully arrested for Driving Under the Influence. A refusal to submit to a breath or blood test once lawfully arrested means that an officer can immediately demand surrender of your license. While every case is different, this means that refusing to take a test is often a mistake, even if you know you will fail the test. The DMV can suspend a license for one year the first time you refuse to take a breath test, whether or not the stop leads to a DUI charge. A second refusal will lead to a two-year suspension, and so on. While you can challenge the license revocation in an administrative hearing, the DMV procedure is not dependent on the results of any criminal proceeding. In other words, even if the DUI charge is dropped, the DMV may still proceed with a license suspension. It is important to note that if you get cited or arrested for a DUI, you have a 10-day window to challenge this suspension by requesting a DMV hearing. Do not miss this 10-day window!

Even first-time offenders face up to 6 months in jail and $1,000 in fines, along with license suspension for 6-months and other penalties. Second- and third-time offenders will face even stiffer penalties: longer jail times, higher fines, and longer license suspensions. A 4th DUI offense will be charged as a felony, which can mean time in state prison. Finally, a DUI offense that resulted in accident, injury, or death can have far more severe consequences. With potential jail time and license suspension, any DUI may impact your ability to keep or find a job, and consequences like hefty fines and hiked-up insurance rates make a DUI very costly. In other words, a DUI conviction will change your life ”for the worse.

Unfortunately, many people mistakenly believe that they cannot fight a DUI, particularly if the breath analysis test showed a BAC above the legal limit. However, just as in any criminal proceeding, there are many ways to fight a DUI charge. For example, breath tests may be attacked if the police failed to accurately calibrate, maintain, or administer the tests and equipment, blood samples may be retested to challenge the accuracy of the government's findings, and procedures used by law enforcement during the traffic stop may be challenged.

Robert Amparan

Robert Marlowe Amparan is an American defense attorney currently based in San Francisco, California. He is a former member of the San Francisco Public Defender's Office and focuses mainly on traffic and criminal defense. He has practiced law in both California State and Federal Courts. Mr. Amparan has garnered local attention in San Francisco for his aggressive defense style. He became notable for successfully defending former JonBenet Ramsey murder suspect John Mark Karr.
In 2012, Mr. Amparan became the owner of California Traffic Defenders, the premier traffic defense firm in the Northern California Bay area.

Hitasha Mowry

Hitasha Mowry is a trial attorney at California Traffic Defenders, who passionately defends clients in both criminal and traffic matters. She is a graduate of Golden Gate University, School of Law. She graduated from GGU in May 2010 and immediately thereafter took and passed the July 2010 California State Bar Examination. Upon being sworn in to the California State Bar, she began practicing both traffic and criminal law. She joined California Traffic Defenders in March 2012. Hitasha attended the University of California at Irvine where she earned her Bachelor's Degree in 2002. Upon graduation, she worked as a paralegal at one of the nation's top civil law firms, Sidley Austin.

During law school, Hitasha interned at the San Francisco District Attorney's Office. There, she assisted district attorneys in building their cases against the clients she now defends.

Born in India, Hitasha has a strong connection to the South Asian community. She is also fluent in Hindi.

Shawn D. Mowry

Shawn D. Mowry is a trial attorney at California Traffic Defenders. He earned his J.D. from the University of San Diego School of Law and was admitted to practice law in California in 2010. A Bay Area native, Shawn attended the University of California at Berkeley where he earned his undergraduate degree in Political Science. A strong advocate for his clients, Shawn no doubt owes his competitive nature to his early athletic success. Shawn was an elite gymnast from an early age and competed for the Division I UC Berkeley Men

Rose Mishaan

Rose is a trial attorney at California Traffic Defenders. She earned her law degree at the University of California, Hastings College of the Law and was admitted to practice law in California in 2009. She is a native of New York City where she earned her B.A. in Political Science from Columbia University in 2003. She is also licensed to practice law in New York.

Before joining the California Traffic Defenders legal team in 2013, Rose spent 3 years working at her own criminal defense practice. During that time she did a substantial amount of law and motion work, as well as direct representation in criminal cases. She was part of a six-person legal team defending against a special circumstances gang murder indictment in San Francisco, and served as co-counsel on a number of serious felony cases.

In addition to criminal law, Rose has a background in international and comparative law, and has authored several published articles in that field. She is a member of the National Lawyers Guild and volunteers with that organization to provide pro bono representation to political protesters.
