C. King Askew

King Askew, a founding partner of Brinson Askew Berry, was inducted as a Fellow in the American College of Trial Lawyers in 2008. He specializes in contract and business litigation and healthcare law. Mr. Askew serves as Counsel to the Harbin Clinic. He is the lead attorney for the Floyd County Board of Education, and has served as a Special Assistant Attorney General of Georgia since 1986.

King also served as the assistant city attorney for the City of Rome from 1975 to 2000, chairman of the Board of Bar Examiners appointed by the Georgia Supreme Court, and president of the Georgia Municipal Attorneys. He continues to be recognized as a Georgia Super Lawyer, a joint project of Law & Politics Magazine and Atlanta Magazine.

A. Franklin Beacham III

Frank Beacham is a partner at Brinson Askew Berry engaged in trial court and appellate work primarily in the areas of business and employment law. While representing industries, municipalities, educational institutions, utilities, and individuals, Frank has assisted clients in civil litigation involving contracts, employment discrimination, civil rights, personal injury, and estate disputes. He also serves as Assistant City Attorney to the City of Rome regarding employment matters.

Prior to joining Brinson Askew Berry, Frank served as law clerk to the Honorable Harold L. Murphy, United States District Court for the Northern District of Georgia (Rome Division), from 2001-2003, and practiced construction law with the firm of Griffin, Cochrane & Marshall in Atlanta from 2003-2004.

Frank received his Bachelor's degree in Mechanical Engineering from Georgia Tech in 1985 and his J.D., magna cum laude, from the University of Georgia School of Law in 2001, where he served on the Georgia Law Review, was a recipient of the Sigmund Cohn scholarship, and was elected to the Order of the Coif. He has been a member of the Georgia Tech Bar Association since it was founded in 2008.

Frank has been appointed to the United States District Court's Magistrate Judge Merit Selection Panel. The Panel reviews the service of Magistrate Judges who are eligible for reappointment, and screens and interviews candidates for appointment as magistrate judges.

Robert L. Berry

Robert L. Berry is a senior partner of Brinson Askew Berry. Bob's medical malpractice, professional and insurance defense enjoys a strong reputation throughout the state. He is a fellow of the American College of Trial Lawyers, served on the executive committee of the State Bar of Georgia from 1994-96, and was recognized as a Georgia Super Lawyer, a joint project of Law & Politics Magazine and Atlanta Magazine. He represents such clients as MAG Mutual Insurance Company, Darlington School, News Publishing Company, Redmond Regional Medical Center (Hospital Corporation of America), and The Brugg North America Companies.

Robert M. Brinson

Robert M. Brinson is a founding partner of Brinson Askew Berry. He engages in an active, hands-on trial practice in Rome and North Georgia and Greater Atlanta, and his litigation, trial and appellate experience after many years of practice includes general business litigation, class actions (Plaintiff & Defendant), complex litigation, personal injury (Plaintiff & Defendant), intellectual property rights, contract disputes, product liability, civil and voting rights, constitutional challenges, and government law. He has tried numerous cases in State and Federal courts, and his trials have included personal injury and wrongful death actions for both plaintiffs and defendants.

In 1979, he briefed and argued City of Rome v. United States, 446 U.S. 156 (1980). In 2003-04, he served as lead and liaison counsel for 56 named defendants in a national class action. (Re Tri-State Crematory, 215 F.R.D. 600 (N.D. Ga. 2003)). He has, every year since 1989, been listed in The Best Lawyers in America in business litigation. Beginning in the 2007 edition, Mr. Brinson was listed in the specialties of Bet-the-Company Litigation, Commercial Litigation and Personal Injury Litigation. He was named in "The Legal Elite:Georgia's Most Effective Lawyers" published in Georgia Trend (2003-Present).

In 2005, he was recognized as one of the Top 10 (top vote getters statewide) of Georgia Super Lawyers, a joint project of Law & Politics Magazine and Atlanta Magazine. He was president of the State Bar of Georgia in 1986-87, and received, in 1996, the State Bar's Award for Distinguished Service to the Legal Profession and, in 2001, the Tradition of Excellence Award. Lee B. Carter

Lee B. Carter is a partner in the firm's litigation group. He maintains an active civil litigation practice, representing a diverse group of companies, financial institutions, and individuals in both state court and federal courtat the trial and the appellate level. Lee is admitted to practice in all Georgia state courts, the United States District Court for the Northern District of Georgia, the United States Court of Appeals for the Eleventh Circuit, and the Supreme Court of the United States.

His recent experience includes:

-Defended chemical company and its founder against breach-of-fiduciary-duty and corporate-veil-piercing claims in state court;
-Defended bio-fuel distribution company and its owner in breach-of-contract action in federal court;
-Defending the holding company of a national chain of nursing homes against claims of wrongful death;
-Defending companies and municipalities against premises liability claims in both state and federal courts;
-Advising and representing regional financial institutions in civil litigation arising from loan defaults;
-Defending construction companies against breach-of-contract and FLSA claims; and
-Submitting amicus curiae briefs on behalf of trade associations.

Prior to joining Brinson Askew Berry, Lee was an associate in the Atlanta office of King & Spalding LLP, where he was a member of the firm's Business Litigation Practice Group. There, his practice focused on complex commercial litigation, including professional liability litigation, consumer class actions, and contract disputes in the financial services, real estate, construction, and defense industries.

Lee graduated magna cum laude with honors from the University of Georgia with a bachelor's degree in History and Political Science in 2005. He was inducted into Phi Beta Kappa while finishing his undergraduate degrees. Lee received his law degree cum laude from the University of Georgia School of Law in 2008. While at the University's School of Law, Lee served on the Editorial Board of the Georgia Journal of International and Comparative Law.

Lee, a native Roman, is also active in the community. He serves on the Board of Directors for Rome and Floyd County Habitat for Humanity, is a member of the Seven Hills Rotary Club and the Coosa River Basin Initiative, and volunteers for the Boy Scouts of America by sitting on Council Eagle Board of Reviews.

J. Anderson Davis

J. Anderson (Andy) Davis is a partner of Brinson Askew Berry. Andy specializes in complex business litigation, personal injury, governmental official liability, and product liability. He serves as City Attorney for the City of Rome, lead attorney for the Rome-Floyd County Development Authority, and Counsel for Shorter University f/k/a Shorter College.

For the past eight years, Andy has been recognized as a Georgia Super Lawyer, a joint project of Law & Politics Magazine and Atlanta Magazine. Andy has tried numerous cases in federal and superior courts. Andy and Bob Brinson serve as Counsel for Cities and Counties in Georgia in ongoing Class Action litigation against the Online Travel Companies for excise taxes (City of Rome, et al, vs. Hotels.com, et al, U.S.D.C., N.D.Ga., Civ. Action No. 4:05-cv-249-HLM). Andy and Sam Lucas tried a week-long wrongful death case in the United States District Court and won a $30 million verdict. Andy and Bob Brinson served as lead and liaison counsel for 56 funeral homes in the class action litigation from the Tri-State Crematory, Noble, Ga. (Re Tri-State Crematory Litigation, 215 F.R.D. 660 (N.D. Ga 2003)).

Andy has been recognized with numerous community and civic awards. He received one of the first ever awarded Georgia Supreme Court Chief Justice Benham Awards for Community Service. Andy, an Eagle Scout, received the Distinguished Service Award from the Rome Jaycees and the Silver Beaver Award from the Northwest Georgia Council of Boy Scouts of America. He has received one of the Heart of the Community Awards presented by the Heart of the Community Foundation and Redmond Regional Medical Center to unsung heroes. In 2002, Andy served as chairman of the board for Leadership Georgia, an affiliate of the Georgia Chamber of Commerce. He has served as a state host for the Georgia Chamber's state-wide Fall Feather Hunt and the Red Carpet Tour.

Norman S. Fletcher

Norman S. Fletcher was sworn in as Chief Justice of the Supreme Court of Georgia on June 28, 2001, and retired from the Court June 30, 2005. Former Chief Justice Fletcher was appointed to the Georgia Supreme Court on December 28, 1989. Justice Fletcher joined Brinson Askew Berry as Of Counsel, bringing with him his 47 years of experience as a trial lawyer, counselor, city attorney, county attorney and general practitioner. Norman began his law practice in 1958 as an associate in the law firm of Matthews, Maddox, Walton and Smith, Rome, Georgia. In 1963, he moved to LaFayette to form a partnership with the late Gerge P. Shaw and Irwin W. Stolz, Jr. While in private practice, he represented the State of Georgia as a Special Assistant Attorney General and he also served as City Attorney for the City of LaFayette and County Attorney for Walker County. He continued his general practice of law in LaFayette until his appointment to the Supreme Court.

Justice Norman has a distinguished record of service to the legal profession and the community. He served as a member of the Board of Visitors of the University ot Georgia Law School (1999-95), and was its Chairman (1994-95). He is a fellow of the American Bar Foundation and the Georgia Bar Foundation and is a Master in the Joseph Henry Lumpkin Inn of Court. In 1989 he served as co-chair of the State Bar's commission on lawyer disciplinary reform. Prior to his appointment to the Supreme Court he served as a member of the State Disciplinary Board (1984-1987), chair of the Investigative Panel (1986-87), chair of Local Government Section of State Bar (1977-78), President of City Attorney's Section of Georgia Municipal Association (1978-79), board member of Attorney's Title Guaranty Fund (1971-75), President of Lookout Mountain Bar Association (1973-74), and President of the University of Georgia Law School Association (1977). While residing in LaFayette, Norman served three terms on the board of the LaFayette Chamber of Commerce and is the former president of the LaFayette Rotary Club.

Norman, while living in Atlanta, was a member of Peachtree Presbyterian Church where he served as a Ruling Elder. He has served as an officer in the First Presbyterian Church of Rome, LaFayette Presbyterian Church and Cherokee Presbytery and as a commissioner to the Presbyterian Church USA General Assembly in 1984 and 1985. Justice Fletcher, the son of the late Frank Pickett Fletcher and Hattie Sears Fletcher. His brother is Frank P. Fletcher, Jr. of Columbia, South Carolina. Norman married the former Dorothy Johnson of Fitzgerald in 1957. They have two daughters and five grandchildren.

Justice Fletcher is also an Eagle Scout.

Frank H. Jones

Frank Jones has a very distinguished record of law practice in Rome and this area dating back to the early 1970's. A native of Canton, Georgia, he attended the University of Georgia, receiving his A.B. degree in 1965, and pursued his law career at Emory University, earning a J.D. degree in 1967. While at Emory Law School, he was a member of Phi Delta Phi, noted law fraternity and a member of the Bryan Society. Between 1977 and 1983, Frank served as Attorney for Floyd County, advising the Commission on legal matters affecting the county and its citizens.

Samuel L. Lucas

A Rome native and 1997 graduate of Darlington School, Sam Lucas joined Brinson Askew Berry in 2006 as an associate. Sam focuses his practice on litigation and has represented both plaintiffs and defendants in state and federal courts regarding a borad range of areas including business ligitation, local-government law, and personal injury.

Sam joined Brinson Askew Berry as an associate after having practiced as an Assistant District Attorney to the Honorable W. Kendall Wynne, Jr., in the Alcovy Judicial Circuit. He returned to his home to begin his civil practice. Sam graduated from The University of Georgia School of Law, cum laude, and was a Notes Editor of the Journal of Intellectual Property Law. Prior to entering Law School, Sam graduated from Emory University in Atlanta, with a Bachelor's Degree in Business Administration with concentrations in marketing and communications. Sam serves as an Assistant City Attorney to the City of Rome and as the Solicitor of the Municipal Court of Rome, Ga., prosecuting traffic and misdemeanor cases.

Stephen B. Moseley

A native of Marietta, Georgia, Stephen is a partner of Brinson Askew Berry. His primary area of practice is representing physicians, nurses, hospitals, and long-term-care facilities in medical negligence cases. He also has extensive experience in handling automobile liability, municipal liability, and premises liability cases. He has tried many cases in the state courts throughout northwest Georgia and metro Atlanta and the federal court in Rome. Stephen also has represented physicians before the Georgia Composite Medical Board and dentists before the Georgia Board of Dentistry.

Stephen is very active in the community. He is a member of the Rome-Seven Hills Rotary Club and serves on the Board of Directors of the YMCA of Rome and Floyd County. He formerly served on the Board of Governors of the Heart of the Community Foundation, including one year as Chairman, and on the Board of Directors for the United Way of Rome and Floyd County. He is a graduate of the Greater Rome Chamber of Commerce's Leadership Rome program. He also has volunteered as a coach for the Rome High School Mock Trial Team and a coach for various youth sports programs in Rome.
