My firm was established in 1995. In 1999, I got married and moved to Richmond, VA. I have an "of counsel" relationship with two other Virginia lawyers. (In this context "of counsel" means that we team up and combine forces for certain cases, but retain separate law firms.) My first "of counsel" is Claude Whitehead. Claude is a former Petersburg prosecutor who was also a special prosecutor in Chesterfield and Dinwiddie Counties. He also focuses on defense of Reckless Driving Speeding cases, especially in Greensville/Emporia, VA, Dinwiddie, VA and Hanover County, VA.

I focus on the serious criminal traffic charges of DUI/DWI and Reckless Driving Speeding in Virginia.

I have written three books on Virginia DUI defense and I am regularly hired by those seeking lawyers in all jurisdictions within an hour of Richmond, VA. My office is actually located in Henrico, VA. Chesterfield and Hanover Counties are also very aggressive in attempting to enforce Virginia's increasingly harsh drunk driving laws.

I grew up in Alexandria, VA and was a prosecutor in Fairfax, VA and I will still get retained by clients charged with DUI in Northern Virginia as well.

Virginia's Reckless Driving laws are the harshest in the country. Any speed above 80 mph can and will be charged as Reckless Driving (even where the speed limit is 70 mph.) I have written a book describing the potentially devastating consequences of a Reckless Driving Speeding conviction in Virginia and it can be obtained for free here. My firm has been regularly hired by executives, lawyers, military officers, professionals with a security clearance and college students who need to attempt to avoid being convicted of the crime of Reckless Driving Speeding.

We offer a free phone consultation. For DUI appointments at my office, where clients are given printed copies of the books I have written on Virginia DUI defense, and I go over on a flat screen TV connected to the internet in my conference room all the ways I look to beat their charge and all the code sections and case law regarding their case, I charge a fee. However, if the client hires me, 100% of that fee is credited to his legal fee.

How did your firm decide on the primary area of practice(s)?

DUI defense, when done well, combines both complex science with a political climate that has denied basic constitutional rights to defendants and allowed junk science to be admitted into evidence and convict people based on that evidence. As someone with a strong sense of fairness for everyone in the judicial process, I consider it a calling to defend those accused of DUI.

Reckless Driving Speeding laws in Virginia are harsh and I am probably the most outspoken opponent of these laws. I tell clients all the time that I didn't create Virginia's Reckless Driving Speeding laws, but hopefully I can be the solution to their problem.

What is your firm's point of view regarding clients educating themselves on legal issues?

I believe that it is the lawyer's duty to educate the public about their rights. That is why I have made my consumer guides "How to Choose a DUI Lawyer in Virginia" and "The Shocking Truth About Reckless Driving Speeding in Virginia" available as immediate, free downloads on my website.

Is your firm willing to review documents prepared by clients?

This really is not applicable to my practice areas.

Is your firm willing to coach clients who want to represent themselves?

I will explain the court process to individuals. I also tell them flat out that if they are charged with the traffic infraction "Speeding" as opposed to the criminal offense of "Reckless Driving Speeding" that I do not recommend that they hire me. However, I never give legal advice to non-clients.

Bob Battle

Upon graduating from law school in 1984, I was a law clerk for United States District Judge James Cacheris in Alexandria, VA. From 1986 to 1990, I was a prosecutor in Fairfax County, VA. I have been in private practice since June 1990.

I am one of the few lawyers who have seen the court from all sides. In my 27 years as a lawyer, I have been a federal judge's law clerk, a prosecutor in one of the busiest jurisdictions in the country, a civil defense lawyer, a civil plaintiff's lawyer and a criminal defense lawyer.

I have also had a second part-time career as a professional comedian and actor. The acting training I have received and the unparalleled experience of having performed hundreds of comedy shows with some of the biggest names in entertainment have given me a tremendous amount of polish and comfort as a trial lawyer.

As I have said, I personally do all of the work on a client's case. I have been practicing for 27 years, so I know what defenses work and what do not work. I emphasize to potential clients that it is an absolute certainty that you cannot win on an issue that your lawyer fails to recognize and raise. In my book "How to Choose a DUI Lawyer in Virginia," I give 20 examples of issues I see other lawyers miss that cause their clients to lose a winnable case.

I love trying cases, have no fear of trying cases and I usually know far more about the prosecution's own evidence than the prosecutor or police officer will know.

Personal interests:

I love spending time with my family, especially date nights with my wife and "guy's nights" with my two sons. I still do professional comedy shows part-time.
