Types of Personal Injury Compensation in Eastern Kentucky

A person who is injured as a result of someone else's actions, negligence, or reckless behavior can recover many types of damages. The goal of awarding damages is to restore the victim as much as possible physically, emotionally, mentally, and financially to the way they were before they were harmed. Thus, damages can include:

Reimbursement for losses that cannot be easily measured, such as pain and suffering, emotional distress, or mental impairment
Lost earning potential for interference with the victim's ability to earn money in the future
Lost wages for income not earned due to the injury
Medical expenses for healthcare bills incurred from the injury.
A Personal Injury Victim's Family Can Recover Damages

This includes awards for loss of affection (known as loss of consortium) and wrongful death. If the injury was caused by a reckless or intentional act, punitive damages may be granted in order to punish the responsible party (as opposed to damages awarded to compensate the victim).

Taking the Next Step Forward, Quickly

Because all personal injury cases are different, it's best to talk to a knowledgeable lawyer as soon as possible in order to protect your rights. Every case has a statute of limitations, which is the legal term for how long a victim has to file a lawsuit after the accident or injury has occurred. Once the time period ends, you can no longer file a claim. In most personal injury cases, the deadline in Kentucky is one year.

Personal injury claims can be incredibly complex to maneuver. A Pikeville KY injury lawyer will examine your case and help you determine the best course of action. Most experienced personal injury lawyers attempt to settle a case because it is the fastest and easiest way to reach an acceptable conclusion for both parties. But if a settlement cannot be reached, then it is crucial to have a competent attorney who will prove your case in court.

Billy Johnson

William "Billy" Johnson grew up in the Dorton area of Pike County, Kentucky, and early on decided to stay in the beautiful Appalachian mountains. Like many others in Eastern Kentucky, Billy's dad worked as a coal miner, a hard job but one that taught his son how to meet challenges head on and persevere. Billy's mother, Mary Anne, was a homemaker, creating a warm and welcoming place for everyone who walked through the doors. Billy's decision to focus on personal injury law was deeply rooted in the compassion for others and strong beliefs in fair and equal treatment that he learned from Bill and Mary Anne Johnson.

After high school, Billy started his own successful DOT drug- and alcohol-testing company. This venture supported him financially through college and law school. He started his law career in 1998.

Today, when Billy is not behind his desk or in the courtroom fighting for his clients, he loves to be out of doors. A motorcycle enthusiast, Billy participates in several Harley Davidson charity rides through the year. He has passed the difficult training to become an instrument-rated private pilot and enjoys flying his own plane over the hills and Bluegrass horse farms of Kentucky. You might find Billy in the garage tinkering on a car or at the shooting range, perfecting his skills. He and his wife, Cody, are active in the Pike County community they know so well, giving back to the area which has given so much to them.

Brittney Schaeffer

Brittney Schaeffer obtained her Juris Doctor from the University of Kentucky College of Law, where she graduated cum laude. She also graduated summa cum laude from Pikeville College, earning a Bachelor of Science in History and Political Science. Prior to joining Johnson Law Firm, Brittney clerked for Kentucky Supreme Court Justice Will T. Scott and interned for United States District Court, Eastern District of Kentucky Chief Judge Karen K. Caldwell.

Brittney decided to practice personal injury law after a family member was involved in a life-threatening accident, and she saw firsthand how devastating such an occurrence can be to a person and his or her family. She is dedicated to treating her clients with care, respect, and understanding all while vigilantly fighting to ensure that they get the maximum amount of relief afforded to them under the law.
