At Graf & Associates, P.C., our Denver child custody lawyers take a direct and honest approach to protecting our clients’ interests and helping them through what is often a grueling experience.
The terms child custody in Colorado no longer applies, much like the term visitation. The phrase “child custody” has been replaced by “parenting responsibility,” which is broken into two separate areas, decision-making and parenting time. Decision making involves how major decisions regarding a minor child will be made such as religious, medical and school activities. Parenting time involves the amount of time the child will spend with each parent, including vacation and holiday parenting time.

Child custody disputes in Colorado are frequently resolved by the retention of a Child Family Investigator (CFI) or a Parental Responsibility Evaluator (PRE). The cost for a CFI is far less than a PRE but is a less thorough evaluation. At Graf & Associates, P.C. we will evaluate your needs and perform a cost-benefit analysis to obtain the best outcome for your case.

Is your firm willing to help a client with one discrete part of a case, without taking on the whole case?

As long as we have not entered an appearance with the Court as legal counsel for a party, we can give advice and assist pro se clients on any portion of their case. Once we have officially entered a case we are required to be involved in every portion of the litigation.

What are your policies about dividing work within the firm to make the process most cost-effective for the client?

We encourage the use of paralegals to handle routine form preparation to minimize expenses. It is our philosophy that a client generally forms a relationship with the individual attorney and not just the firm. We therefore strive to keep the case with the initial attorney but will use lower-costing counsel or paralegal assistance for routine matters

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

In order to save costs, we attempt using settlement conferences without the costs of a mediator. If unsuccessful, we use mediation services commensurate with the scope and complexity of the case. For example, a simple low asset domestic relations case may be settled using the "multi-door mediation services" offered at a low cost by the judicial district. A complex case may require the expertise of a subject matter expert mediator from services such as JAG or JAMS.

Does your firm provide pro bono legal services or otherwise participate in your community?

Our firm routinely takes Court appointments and provides pro bono representation for the underprivileged.

What distinguishes your law firm from others?

The attorneys at Bertram & Graf, LLC are former prosecutors and judges who spent virtually every day in Court. As a result, we have a unique insight as to the inner workings of the Court bureaucracy and what constitutes effective advocacy.

What is your firm's point of view regarding clients educating themselves on legal issues?

We believe our clients should be educated in the legal process and laws affecting their case so they can set reasonable goals and expectations. Every case may eventually result in a courtroom hearing or trial. Therefore, an informed client will do a better job informing counsel of relevant evidence and is a better witness with a thorough understanding of the theories of the case and the intended effect of their testimony.

Is your firm willing to review documents prepared by clients?

In a domestic relations setting, our firm offers couples help in mediating and drafting property and debt settlements known as a "Separation Agreements," "Parenting Agreements" and Child Support Orders." For individual representation, we review documents prepared by our clients, improve them and convert them into legal pleadings that are acceptable to the Court.

Is your firm willing to coach clients who want to represent themselves?

We offer a wide range of services including advice and drafting of documents for pro se litigants.

Gregory Graf

Gregory Graf graduated from Indiana State University in 1980 and the University of Tulsa Law School in 1983, where he was an editor of the Law Review. He commenced his legal career as an Assistant District Attorney. He is a former Assistant United States Attorney for the District of Colorado where he served in the Major Crimes Unit, the Rocky Mountain Organized Crime and Drug Task Force, and Appellate Divisions. He has numerous published opinions relating to his prosecutions of complex white-collar crime and computer fraud cases. He also serves as a mediator and special master in the state court system.

Mr. Graf was an Adjunct Professor with the Lester B. Pearson Peacekeeping Centre, Nova Scotia, Canada where he taught international human rights law. He also teaches the law of armed conflict to members of the United Nations peacekeeping missions. He is a Colonel in the Colorado Air National Guard and is a combat mission ready F-16 pilot. He served as the Chief of Staff for Task Force West during Operation Iraqi Freedom. He has also served as a staff judge advocate and military judge in the Colorado Air National Guard. As part of his duties, he was legal advisor to the Office of the High Representative in Bosnia and Herzegovina. In that capacity, he was assigned to the investigation and prosecution of organized crime members and war criminals.

Mr. Graf is a member of the American Trial Lawyers Association, Colorado Bar Association, Denver, Arapahoe and Douglas County Bar Associations. He holds the prestigious rating of an
