We have successfully handled many bankruptcy cases. We were fortunate to represent an individual who owed a first and second mortgage on his primary residence and fell behind on both mortgages. After doing an analysis on the value of his home we determined that the second mortgage holder was completely undersecured, meaning there was not any equity in the property for the lender to attach their mortgage. Because we are well versed in the bankruptcy laws and procedures, we were able to obtain a Court order on behalf of our client whereby it was ruled that the second mortgage holder did not have a valid lien against the property and would be paid as an unsecured creditor. Essentially, the second mortgage holder received pennies on the dollar and our client was relieved from having to make monthly payments on the loan.

Is your firm willing to help a client with one discrete part of a case, without taking on the whole case?

We have no problem handling a bankruptcy for our clients and referring them to outside counsel for another area of law that we do not practice. We also have no problem working with clients who are being represented by a another law firm on a separate matter unrelated to the bankruptcy.

What are your policies about dividing work within the firm to make the process most cost-effective for the client?

All legal analysis is handled by the attorneys in the office. We do utilize support staff who assist the attorneys in managing the day to day tasks that are involved in a busy law practice.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

Most bankruptcy cases do not require mediation but if we feel it would be helpful for our client we are certainly not against pursuing it as a resolution tactic.

Does your firm provide pro bono legal services or otherwise participate in your community?

Our firm has been handling pro bono cases for many years as we feel it is important to give back to the community.

What distinguishes your law firm from others?

Our firm is unique in that we give a lot of personal attention to our clients since we do not take on too many cases. Although we are quite busy, we never want our clients to feel as though they are just another face.

What is your firm's point of view regarding clients educating themselves on legal issues?

We want our clients to be as educated as possible so that they can understand the reasoning behind the course of action we pursue in their claim.

Is your firm willing to review documents prepared by clients?

We are willing to review clients prepared by clients in some instances.

Is your firm willing to coach clients who want to represent themselves?

We do not recommend that an individual or small business owner attempt to represent themselves in a bankruptcy proceeding because there are many potential pitfalls that could have dire consequences for the client.

Howard J. Bernstein

The firm was established in 1998 by Howard Bernstein. Mr. Bernstein had been previously working for a financial company and decided to go in to private practice to help individuals who were overwhelmed with financial burden.
